to the Director concerning the Suttee's project to gather
and process data on administrative proceedings.
We have discussed your letter with your Chief Counsel,
Mr. Teasterwald. As indicated to him, the Central intelligence
Agency has no regulatory functions and does not cend t adminis-
trative proceedings as delineated by the Subcommittee study. Vj

Two years ago, the Subcommittee on Administrative Practice and
Procedure continued, for fiscal year 1963, the project initiated by
the hdx1,:",nistrative Conference of the United States (1961-62) to
gather and process data on administrative proceedings.

ceedings, is basic to any attempt to understand and improve the
administrative process.
To prevent the loss of information since 1963 and to avoid a break
in continuity, the Subcommittee is again assuming the role which
it flalieves the Administrative Conference wi L assure when it is
established, Enclosed herewith are instructions for the submission
of data for fiscal years i96., 1965, and 1966 To maintain consis-
tency, the ground rules are the ssz e as for FY 1963 except in one
jart c l ar: closer attention is given to cases decided on the merits
by modified procedures vhich avoid an oral hearing,
in addition to use by individua* agencies and students of regulatory
processes, the data compiled by the Subcommittee and the original.
Adainistra;,ive Conference has been the subject of analysis by
Professor Stuart Nagel of toe `university of Illinois. Professor iTagel
ea plo::,.:d several methods by ::__ ch data of this kind can shed light on
the extent of protraction and provide guidance for the reduction of
delay. His study will be available as a Committee Print in the near
future.

The S,..'.)ccmrfjttee is co--zscio~:s of the added workload involved in this
request since it covers three fiscal years. It is also true that
some agencies are better prepared by reason of having retained data in
aaticipation of continued requests like that for FY 1963. Staff
consultation with agencies with larger caseloads has indicated that a
retac;a dace of December 59 1966 would provide a reasonable period for
processing replies.
I appreciate your cooperation in this effort. I also hope that
a ivation of the Administrative Conference Act will provide an orderly
system for the gathering and analysis of essential information on the
Adm:_nistrative process so that a request of this scope will not again
be necessary.
