This memorandum contains a recommendation for your approval in paragraph 5. Background: 2. The Kennedy Committee has reviewed sanitized versions of two IG reports to the DCI: the TOP SECRET 1963 report on drug-related activities under Project MKULTRA and the 11 February 1975 SECRET summary prepared for you on "'Behavioral Drugs and Testing." Committee staffers have now asked that we declassify these reports in whole or in part for release to them. Certain segregable portions of these reports have been identified as releasable in declassified form by the DD/S&T., DD/O, and my staff. Staff Position: 25X1 3. However, these reports are internal advisory communications from the Inspector General to the DCI. We have taken the position in connection with the Freedom of Information Act in th such reports are exempt from release under exemption 3-b-5tp I This stand is similar to that taken recently by SecretaryKissinger regarding advisory papers from members of his:staff. I believe declassification of these Kennedy-requested reports in whole or in part would set a seriously harmful precedent with regard to future requests for IG reports under the provisions of the Freedom of Information Act. Moreover, it would doubtless affect the manner, thoroughness and integrity with which inspection material would be presented for the consideration of the DCI in the future. 4.
