~ 1. What follows are my comments on the draft of your
memorandum to the Director and suggested changes to the
proposed Executive Order.
a. Change the last three lines of the introductory
paragraph of your memorandum to read as
follows
of the CIA. as received from the White House
on 9 September. We recommend the following
changes be made. A revised version of the
proposed Executive Order incorporating these
changes is attached.
b. On page 3 of your memorandum, change line 9
of Section 14 to read:
of United States criminal laws may be ,
transmitted. " (To permit the .... , , ,
c. I believe that Section 15 should be recast as follows:
Section 15: Any information currently in the
possession of CIA about United States citizens,
the collection or retention of which would not
have been permitted under Sections 13 or 14

of this Order, shall be disposed of in accordance
with the provisions of law and procedures authorized
by the Director of Central Intelligence, except to
allotiv the retention of only those records as the
Attorney General may determine are required for
possible judicial proceedings.

If you accept this proposal, your memorandum and the revised
version of 'the Executive Order would have to be changed to
conform.
2. I suggest that you add a concluding paragraph to your
memorandum as follows:
After you have decided on-these proposed
revisions, I can prepare a memorandum to General
Scowcroft transmitting your comments.
