MEMORANDUM FOR THE RECORD
SUBJECT: Meeting with House Select Committee Staffers
1. Saturday afternoon I spent about two hours with Emily Sheketoff
and Edward Roeder, staff members of the House Select. Committee. I briefed
them generally on what the Office did. I mentioned each of the regulatory
procedures which require components of the Agency to get legal approval.
I spent some time on the opinion writing of the Office in the finance field.
I also explained our role in proprietaries, both in formation and liquidation.
2. Roeder seemed particularly disturbed when I explained our
position of not permitting Agency employees to perjure themselves in court.
I explained that, where an individual is under cover, we will brief both
the judge and counsel for both parties. This disturbed Roeder on the
grounds that this would result in a false record in the court which could
mislead private citizens if they were to search court records. I explained
that in many cases there was simply no record made of the cover employment
where it was not truly germane to the issues before the court. He wanted
to know by what authority judges could do this. I indicated no judges had
ever questioned this and I stated I assumed they balanced the extremely
peripheral rights, if there were any, of a private citizen and the responsi-
bilities placed on the Agency to perform its functions as being paramount.
