SUBJECT : Authorization for COMUSMACV to Release Certain
Military Intelligence Information to Free World
Military Assistance Forces, Vietnam
REFERENCE : Electrical Message to USIB,. DTG 30/1635Z Dec
1. As of 31 December 1965, the United States Intelligence Board
approved the statement on the subject recommended by the Acting Director
of Central Intelligence in paragraph 4 of the reference message, subject
to the following amendments requested by Mr. Helms, and 25)(1
General Carroll, respectively:
a. In the introductory portion of paragraph 4, insert "Acting"
before "Director of Central Intelligence", and the words "applying
only" after "the following exception".
b. In sub-paragraph 4. E), after "applicable to" insert
"all DOD military intelligence information originating in RVN
on Vietnam, Laos and Cambodia prior to 1 January 1966 and
to all".
2, A copy of the USIB-approved statement, as transmitted on 31
December 1965 by the Director, DIA to CINCPAC and COMUSMACV,
is circulated herewith for the information and guidance of all USIB
member agencies

USIB-Approved Statement Authorizing COMUSMACV to Release Certain
Military Intelligence Information to Free World Military
Assistance Forces, Vietnam, 31 December 1965
?
In view of requirements arising from the present conflict in Vietnam,
the Acting Director of Central Intelligence, with the concurrence of the
United States Intelligence Board, authorizes the following exception
applying only to the provisions of para. 6.b.(1) of Director of Central
Intelligence Directive No. 1/7:
a. Military intelligence information relating to hostile
activity in Vietnam, Laos, and Cambodia contained in classified
documents, which do not repeat not bear (control markings pursuant
to ?DCID No. 1/7, may be released to the armed forces of
b. COMUSMACV is authorized to effect the release of such
military intelligence information to the above armed forces on a
need-to-know basis as required for the accomplishment of their
mission as part of the Free World Military Assistance Force,
Vietnam.
c. Information released in accordance with 4. and b.. aboare
will be paraphrased or otherwise sanitized as may be necessary
to ensure adequate protection to intelligence sources and methods.
d. The armed forces listed in para. a. above receiving such
military intelligence information are authorized to discuss such
information with each other.
e. This exception is applicable to all DOD military intelligence
information originating in RVN on Vietnam, Laos and Cambodia
prior to 1 January 1966 and to all military intelligence information
collected on and after 1 January 1966. It will be reviewed annually,
or if circumstances dictate, at lesser intervals by the United
States Intelligence Board, to determine that the exception is still
required.

The National Security Council, the Acting Secretary of the Treasury,
the Attorney General, and the Director, Bureau of the Budget at the
418th NSC Meeting on Thursday, September 10, 1959 (NSC Action
No. 2125):
b. Requested the Departments of State and Defense, consulting
as appropriate with other agencies, including the Atomic
Energy Commission and the Central Intelligence Agency, to
prepare a single, up-to-date, comprehensive, self-contained
statement of policy on the release of classified military in-
formation to foreign governments and international organiza-
tions, as recommended by the NSC Representative on Internal
Security; and further requested that such policy statement be
transmitted to the National Security Council for its informa-
tion.
C. Agreed that the statement of policy to be prepared pursuant
to b above should include appropriate provision for voting
representation by the Atomic Energy Commission and the

Central Intelligence Agency on items of direct concern
to them under consideration by the State-Defense Military
Information Control Committee or on unresolved issues of
direct concern to them referred by S-D MICC to higher
authority.
d. Noted that the statement of policy referred to in b above
will not alter the special responsibilities of the Director of
Central Intelligence and the United States Intelligence Board
under NSCID's Nos. 1 and 5 and relevant agreements between
the Director of Central Intelligence and the Secretaries of
State and Defense.
e. Requested the S-D MICC to make a continuing review of the
policy prepared pursuant to b above and to report to the
Council annually on the implementation of the policy.
L. Noted that the responsible departments and agencies, including
the S-D MICC, will implement the recommendations referred
to in paragraphs 2 and 3 of the 'reference memorandum of
August 27, 1959, as modified on the basis of the Planning
Board comments contained therein; except to the extent that
the Planning Board comments in paragraph 3 on Recommenda-
tions 1-D and 1-H have been modified by the action in c above.
Accordingly, the above action, as approved by the President, is trans-
mitted herewith for appropriate implementation.
