Hpprovea rorrceiease zuusiuuiz i : L;iH-KUruurcu1 (J1 (uu1 uUbuuby-3 7 May 1948 FOR: Major General Charles R. G telly USA Following are the notes relating to our conversation of this morning: 1. an administrative point of viaa. the pricy difficulty experienced 'as lack of detailed enabling lei isla..tion to support CIA' unusual administrative problems. It was thci:.Yht, and properly-ao, that so much detail should not be put in leg#i station of the brad policy nature of the National Security Act. This problem has now been met by submission to the Congress of detailed enabling legis- lation. 2. In its performance of the inteili.. ce tunct onn outlir d in the National Security Act, the primary df triculty exp:!rienced by CIA has been in certain .eakne3s Of langueae in para rsrh l{ !(d) concerning the meanie ; of' coordination of intelligence activities. Where the act states "it shall be the duty of the Agency * * C to advise the National Security Council * * * (*ad) to make re .nda- tions to the National Security Council 'or tb3 coordination of such intelligence activities", it has been strong;r argued that this places on the Director a responsibility raerel,r to obtain cooperx- tion among the intelligence agencies. This v3akness cif language and the ensuing controversy might have been A .iminated by the insertion after the phrase, "it shall be the Iuty of the Agency'", the following words: "and the Director is her,4by empo.ered", or some other such phrase indicating the intent of Congress that the Director was to have a controlling voice in the coordi n`ati.on, subject to the direction of the National Cecil:-?ity Coura` 1. However, as time has progressed the coordination between the Departments sand the Central Intelligence Agency has improved, and is continuing to improve, to such an extent that I do not believe now, now or amended legislation is necessary.
