Regarding Representation Allowances
1. This is in response to your request of 14 September 1.976 that
this Office provide an opinion on the basic legal authority for the Agency
to provide for representation allowances for senior CIA officials at posts
abroad. Your query was prompted and accompanied by a DDO memo to
the DCI dated. 3 September 1.976 setting out DDO's proposed annual
schedule of representation allowance authorization for FY 1977.

Agency's existing policies and practices in the area of representation
allowances raises significant and potentially troubling political and
legal questions. Accordingly, this Office believes that it would be use-
ful in the near future for representatives of DDCI, OGC, DDO, IG,
OLC and the Office of Comptroller to conduct a coordinated review and
analysis of the manner and scope of the representation allowance expend-
itures presently being made by the Agency and the possible political
operational arid legal ramifications presented by this ongoing pattern of

SUBJECT : Approval of Representation Allowances
REFERENCE "Representation Allowances"
1. Deputy Directors shall submit to the Director, prior to the
beginning of each fiscal year, their proposed schedule of maximum allow-
ances for senior officials under their jurisdiction assigned to permanent
posts of duty outside the continental limits of the United States. After
approval by the Director, Deputy Directors are authorized to grant rep-
resentation allowances, and to make adjustments therein, within the total
amount app:roved by the Director provided, however, that any adjustment
resul.ti.ng in an allowance exceeding $3, 600 per annum must receive prior
approval by the Director.
2. Deputy Directors are also authorized to grant representation

in a travel status in an area outside the continental limits of the United
