This is a response to your letter of 14 November 1983 in
which you appeal the decision of this Agency dated
5 August 1983 which you understood as denying your Freedom of
Information Act (FOIA) request for "information on a MKULTRA
mind control and manipulation psychological experiment
conducted by...West Virginia University" on you.
Your appeal. letter has been presented to the Central
Intelligence Agency Information Review Committee. Pursuant to
the authority delegated under paragraph 1900.51(a) of Chapter
XIX, Title 32 of the Code of Federal Regulations, Mr. James H.
Taylor, Inspector General, has determined that the fact of the
existence or nonexistence of any documents which would reveal a
confidential or covert CIA connection with, or interest in,
matters relating to those set forth in your request is
classified pursuant to the appropriate Executive order.
Further, the fact of the existence or nonexistence of such
documents would relate directly to information concerning
intelligence sources and methods which the Director of Central
Intelligence has the responsibility to protect from
unauthorized disclosure in accordance with subsection 102(d)(3)
of the National Security Act of 1947 and section 6 of the CIA
Act of 1949. Accordingly, pursuant to the Freedom of
Information Act exemptions (b)(1) and (b)(3) respectively, your
appeal is denied. By these statements, we are neither
confirming nor denying that any such documents or records exist.
In accordance with the provisions of the Freedom of
Information Act, you have the right to seek judicial review of
the above determinations in a United States district court.

Your letter of 14 November 1983 was received on 18 November.
This letter presented an appeal pursuant to the Freedom of
Information Act of the decision in our 5 August 1983 response
to your request for information on 'whether West Virginia
University conducted psychological, pharmacological or other
experiments during the time that [you were] enrolled . . . in
conjunction with the CIA.' Arrangements will be made for
consideration of your appeal by the Information Review
Committee.
We endeavor to be fair to all requesters and have determined
that a first-received, first-out policy is the most equitable
way of processing appeals. We have approximately 115 cases
pending. Please be assured, however, that your appeal will be
processed as quickly as possible and that you will be advised
on the outcome as soon as our processing has been completed.
