Dear Mr. Koch,
I wish to appeal the decision of June 12, 2007, denying me access to files of Jozef (Jose
Swiatlo. I believe that neither of the exemptions noted applies in this case for the
following reasons:
Since 110
defection both the CIA and the Polish intelligence system have been reorganized sever4
times and in the case of the latter, it transitioned from a totalitarian organization to a t41
democratic one with Poland becoming a close ally of the U.S. and a member of NATO.
Swiatlo died in 1985.
So invoking the National Security Act of 1947 and/or the CIA Act of 1949 is of do
-
relevance in this case.
(2) Furthermore, the CIA has released over time much more sensitive information than I
am requesting, as shown on the Agency's website (Family Jewels!). But the most
compelling recent example is the case of Col. Ryszard Kuklinski, exfiltrated from Poland
in 1981, who provided the Agency with highly sensitive information on the Warsaw Pact
and preparations of the Soviet Union to crush "Solidarity" in Poland. The Agency
assisted Benjamin Wiser of the New York Times to write a very revealing monograph "A
Secret Life: the Polish Officer, His Covert Mission, and the Price He Paid to Save His
Country" (2004).1
(3) As I mentioned in my original request, the Polish authorities declassified all Swiatlo
files and historians can now work with the available documents. I am currently working

with a Polish historian on a book about Swiatlo, so the Agency materials would be very
important to us as they will allow to present a formidable story of a person, who was in a
major way responsible for the political changes in Poland in 1956.
