This responds to your 13 July 2007 letter appealing our 12 June 2007 response to your
Freedom of Information Act request for "information of records on Jozef (Josef) SWIATLO,
lieutenant colonel of the Polish security service, who defected to the United States in December
1953."
We regret to inform you that you were mistakenly granted appeal rights in our 12 June
2007 response to you. A different requester has previously requested this information, and their
case was processed through the appellate level and closed on 10 May 2007. We therefore cannot
accept your appeal under the rules outlined in part 1900 of title 32 of the Code of Federal
Regulations, Section 1900.42(c).
I have enclosed a highlighted copy for your reference and retention, and trust you will
understand the equitable and legal reasons for our decision.
