C. 20505 To The FOIA Officer: This request is made under the federal Freedom of Information Act, 5 U.S.C. 552. Please provide conies of the following documents maintained by the CIA: All documents relating to former CIA Officer and accused espionage agent Edward Lee Howard (SSN . Mr. Howard was indicted by a Federal Grand Jury in New Mexico in 1985. Howard was a fugitive from justice when he died July 12, 2002, in Russia. As you know, the FOI Act provides that if portions of a document are exempt from release, the remainder must be segregated and disclosed. Therefore, I will expect you to send me all nonexempt portions of the records which I have requested, and ask that you justify any deletions by reference to specific exemptions of the FOI Act. I reserve the right to appeal your decision to withhold any materials. I am prepared to pay reasonable search and duplication fees in connection with this request. However, the FOI Act provides for waiver or reduction of fees if disclosure could be considered as "primarily benefiting the public." I am a journalist employed by KRQE-TV News, and intend to use the requested information as the basis for a broadcast news story. Therefore, I ask that you waive all search and duplication fees. If you deny this request, however, alto the tees exceed $0.00, please notify me of the charges before you fill my request so that I may decide whether to pay the fees or appeal your denial of my request for a waiver. Was his death ever confirmed? Did Consular officials ever view, collect, bury or repatriate his body? Answer: According to Russian police authorities, Edward Lee Howard died in Moscow on July 12, 2002, as the result of a fall in his residence. His body was cremated privately at the instructions of his next of kin. Out of respect for the privacy of his family, we have no further comment.
