As you will recall, in our 12 July 2002 letter we informed you that we had already initiated searches for this material for a FOIA request received prior to yours. We cross-referenced your request to the earlier one in order to send you any records that were found to be releasable. The earlier case was recently concluded. Enclosed is material that can be released in segregable form with deletions made on the basis of FOIA exemptions (b)(1), (b)(3) and/or (b)(6). We determined that additional material is properly classified and must be denied in its entirety on the basis of FOIA exemptions (b)(1) and (b)(3). An explanation of exemptions is enclosed at Tab A with copies of the documents. We also located United States Government material that CIA did not originate. This material appears to be relevant to your request and has been referred to its originating agency for review and direct response to you. You have the right to appeal these decisions concerning the Tab A records by addressing your appeal to the Agency Release Panel within 45 days from the date of this letter, in my care. Should you choose to do this, please explain the basis of your appeal. We have also enclosed material at Tab B that was previously released to a requester in connection with an ongoing litigation. Redactions were made on the basis of FOIA exemptions (b)(3), (b)(4), (b)(6), and (b)(7)(C). Should any additional information be released as a result of that litigation, copies will be provided to you. Those regulations state that no appeal shall be accepted if the information in question is the subject of litigation in the federal courts. Therefore, as a result of the pending litigation and the response in this letter, you have no appeal rights regarding records at Tab B. As a requester in the "news media" fee category you are entitled to the first 100 pages free of charge. Copying costs are ten cents per page. Therefore, the cost associated with processing the enclosed 658 pages amounts to $55.80.
