Marjorie Steffen and her husband Your letter states that you would like to confirm that some of the individuals listed above were CIA employees. Please use the reference number above when corresponding about this request. The portion of your letter concerning information on yourself will be addressed under the Privacy Act in separate correspondence with reference number P-2010-00495. We need as much identifying information as possible before we can effectively search our files for information on an individual. We require the full name, date and place of birth and citizenship status of each of the above named individuals. If any of the individuals is a lawful permanent resident (LPR) or a naturalized U.S. citizen, we require the LPR or naturalization number and the date that status was acquired. Without this data, we may be unable to distinguish between individuals with the same or similar names. If any of the individuals are deceased, we require some evidence of death, such as a death certificate, an obituary, or press statement to ensure there are no privacy issues. Agency regulations encourage requesters seeking information on living third parties to provide a signed affidavit or declaration from the third parties waiving all or some of their privacy rights. We can search without this authorization, but if we locate responsive records, privacy concerns may require us to protect the information from release. Approved for Release: 2021/11/10 C05517122 Approved for Release: 2021/11/10 C05517122 FOIA exemption (b)(6), a copy of which I have enclosed for reference and retention, requires us to protect information "the disclosure of which would constitute a clearly unwarranted invasion of personal privacy." In reaching this determination, we use the test our enclosed regulations outline at 32 CFR � 1900.32(b): "the Agency will balance the privacy interests that would be compromised by disclosure against the public interest in release of the requested information." Therefore the waiver will assist us with this determination. As you are aware, the FOIA authorizes agencies to collect fees for records services and we note your willingness to pay $100. Based on the information provided in your letter, your request falls into the "all other" fee category, which means that you will be required to pay charges that recover the cost of searching for and reproducing responsive records (if any) beyond the first 100 pages of reproduction and the first two hours of search time which are free. Copies are ten cents a page. A fee schedule is enclosed and in accordance with Section (a) of the schedule, search fees are assessable even if no records are found or, if found, we determine that they are not releasable. This means you will be charged even if our search results are negative or it is determined that no information is releasable under the FOIA. With respect to searches on it is the policy of this agency not to charge fees for records searches relating to a requester's immediate family, and as a matter of administrative discretion, there will be no charge for processing the portion of your request concerning With regard to questions posed in your letter regarding relationships, meetings or associations of various individuals, please be advised that under the FOIA, federal agencies are not required to conduct research, answer questions, or search through collections of material to determine if any of it is relevant. We will hold your request in suspense for 45 days from the date of this letter pending receipt of the following information on each individual: full name, date and place of birth; citizenship status; LPR number and date acquired; privacy release or proof of death (as appropriate); and your commitment to pay fees as described above.
