Suite 500 Washington, D.C. 20036 Reference: F92-2660 (formerly F90-0858) Dear Mr. Burr: Pursuant to the District of Columbia District Court decision in National Security Archive v. Central Intelligence Agency, we are initiating the processing of National Security Archive cases held in abeyance pending resolution of fee issues. Your request, formerly F90-0858, has been assigned reference number F92-2660 for identification and tracking purposes. Specifically, you are requesting "articles on the Berlin crisis published in any CIA weekly or monthly intelligence summaries or reports, between November 10, 1958 and December 31, 1960." You have agreed to pay copying costs assessable in the category of "representative of the news media." Accordingly, we have accepted your request; it will be processed in accordance with the Freedom of Information Act (FOIA), 5 U.S.C. 552, as amended, and the CIA Information Act, 50 U.S.C. 431. Our search will be for documents in existence as of and through the date of this acceptance letter. Concerning your request for a waiver of fees, the FOIA, 50 U.S.C. �552(a)(4)(A)(iii), specifically provides that "[d]ocuments shall be furnished without any charge or at a charge reduced below the fees established under clause (ii) if disclosure of the information is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the [United States] government and is not primarily in the commercial interest of the requester." We have reviewed your request and have determined that the information you seek from agency files would not contribute significantly to the public understanding of the operations or activities of the United States Government. Accordingly, in this instance, your request for a fee waiver is denied.
