Mr. Houston and the undersigned met with Mr. Henry E. Petersen, Assistant Attorney General, Criminal Division, Department of Justice and Mr. Kevin T. Maroney, Deputy Assistant Attorney General, Internal Security Division, Department of Ju"stice at their request. They asked us to read a portion of Howard Hunt's testimony before the grand jury which was being made available later in the day to the defense by Judge Byrne in the Ellsberg case. They pointed out that undoubtedly this testimony would be made public during the course of the day. 2. The testimony gives reasonably accurate details of Hunt's securing support from CIA and describes the burglary of the office of Dr. Fielding, Ellsberg's psychiatrist. In view of this, Mr. Petersen stated he felt that a substantial portion of the material previously given to the Attorney General by the Director's memorandum of 18 October 1972 and to Mr. Petersen by John S. Warner's memorandum of 21 December 1972 would also have to be furnished the Judge including Xerox copies of the film which had been developed by the Agency for Hunt. Mr. Petersen pointed out that in the as yet unpublished testimony by Ehrlichman before the grand jury, Ehrlichman states that once he learned of the burglary of Fielding's office he informed Mr. Petersen. Mr. Petersen does not recall this but the pictures in the film clearly show Fielding's office and these have been in Mr. Petersen's possession since 3 January 1973. We then identified the items e. through h. attached to the Director's memorandum which were deemed relevant and also eliminated certain items attached to the Warner memorandum. Mr. Houston indicated that he thought the material desired by Justice could be declassified and we undertook to retype the documents with no classification and agreed to furnish them to Justice first thing Monday morning. 4. Subsequently, Messrs. Houston and Warner met with the Director and advise4 him of all of the above.
