1. Attached for your review and comment is the second
draft of the proposed Intelligence Community Legislative
Program for the First Session of the 101st Congress. It is
based upon. proposals received in response to the call for items
as contained in our 26 July 1988 memorandum. We ask for your
comments by 2 September 1988.
2.' Items marked with asterisk are those which, as of this
date, have been only informally transmitted by the
agency/component involved. We would appreciate your comments
on them. Their inclusion in the final version of the Program,
however, will be contingent upon formal transmission to us by
2 September.

101/1 - 1: Fiscal Year 1990 Intelligence
Authorization Act
The Director of Central
Intelligence will submit to
the Office of Management and
Budget for clearance a
proposed Fiscal Year 1990
intelligence Authorization
Act to be transmitted to the
Congress.
101/1 - 2: Protection of Intelligence
Information
The Director of Central
Intelligence may propose
legislation to provide
criminal penalties for the
unauthorized disclosure of
classified information by
Federal employees or others
having authorized access to
classified information. He
may also support this
proposal as contained in
other legislation.
101/1 - 3: Relief From Section 3504
Motions.
The Director of Central
Intelligence may propose or
support legislation seeking
relief from frivolous or
burdensome motions filed
under the. provisions of 18
U.S.C. ?3504 (litigation
concerning sources of
evidence).

Proficiency Incentive Pay

Department of Defense, the
Director of Central
Intelligence may propose or
support legislation to
authorize the Defense
Intelligence Agency to
provide incentive pay to
civilian employees for
foreign language proficiency.
101/1 - 5: DIA Death Gratuity
If not acted upon favorably
by the 100th Congress, the
Director of Central
Intelligence, at the request
of the Department of Defense,
may propose or support
legislation authorizing
dependents of DIA personnel
killed in the line of duty
abroad to receive the general
DoD death gratuity.
101/1 - 6: *DIA Overseas Personnel
Benefits Comparability
At the request of the
Department of Defense, the
Director of Central
Intelligence may propose or
support legislation to give
the Secretary of Defense
discretionary authority to
ensure that DIA personnel
serving overseas receive
benefits similar to those
enjoyed by members of the
Foreign Service.

Post Service
The Director of Central

legislation to amend the
Federal Employees' Retirement
System (FERS) Act of 1986 to
allow CIA employees covered
thereunder to waive an
"unhealthful post"
differential and instead
receive extra retirement
credit similar to the manner
in which such credit is
received under the Central
Intelligence Agency
Retirement and Disability
System (CIARDS) .
