Attached are copies of the above-captioned bills for your review and comment. STAT 2. Both bills are designed to reduce the licensing burden on exporters. They both open up trade to the People's Republic of China and relax national security controls on reexports as well as on exports of low technology items. In certain circumstances, the export of goods or technology is allowed when goods or technology of comparable quality are available from non-U.S. sources. Section 4(b) of the Senate bill requires intelligence agencies to release information regarding such goods and technology, albeit consistent with the protection of sources and methods. There is no such requirement in the House bill. However, section 7 of the House bill appears to affect the Agency in that it allows referral to an appropriate agency of an application for an export license when it is deemed that that agency has relevant knowledge not available in the Department of Commerce. 3. The schedule for consideration of these bills is currently uncertain. However, inasmuch as the Agency is directly affected by one bill and because of the seemingly fast track which trade legislation is on, I request that you relay your comments to me at your earliest convenience.
