(b)(3) October 29, 2009 Dear Mr. Gingeras: Central Intelligence Agency Washington, D.C. 20505 APPROVED FOR RELEASES This responds to your undated letter, which we received on 12 August 2009, appealing our 15 July 2009 final response to your Freedom of Information Act (FOIA) request for information about Ihsan Sekban (also known as Laz Ihsan or Ihsan Seymanoglu), "who was a Turkish drug trafficker who was based in Istanbul and Izmir and was active between 1947 and 1980." Specifically, you appealed our determination that we can neither confirm nor deny the existence or nonexistence of records on the basis of FOIA exemptions (b)(1) and (b)(3). The Agency Release Panel (ARP) considered your appeal and determined that the Agency can neither confirm nor deny the existence or nonexistence of records responsive to your request on the basis of FOIA exemptions (b)(1) and (b)(3). Therefore, in accordance with Agency regulations, the ARP denied your appeal. For your information, Agency regulations are set forth in part 1900 of title 32 of the Code of Federal Regulations.
