This is further to our letter dated 22 March 2007 pertaining to your
18 February 2007 Freedom of Information Act (FOIA) request for:
1. Any and all records cited in "the 9/11 Commission Report:
Final Report of the National Commission on Terrorist Attacks
upon the United States" (New York; W.W. Norton, 2004).
2. Any and all background documents used in the preparation of
"The 9/11 Report".
3. Any and all records cited in the National Commission on
Terrorist Attacks (Staff Monographs).
4. Any and all records cited in "The 9/11 Commission" Staff
Reports.
5. Any and all background documents used in the preparation of
"The 9/11 Commission" Staff Monographs.
6. Any and all background documents used in the preparation of
"The 9/11 Commission" Staff Reports.
7. Any and all records cited during "The 9/11 Commission" Staff
reports.
8. Any and all background documents referenced or used in the
preparation of questions during "The 9/11 Commission"
hearings.
9. The complete, unredacted text of the Congressional Joint
Inquiry into The Terrorists Attacks of September 11, 2001.
10. The complete, unredacted text of the CIA Inspector General's
report, "CIA Accountability With Respect To The 9/11
Attacks".
We have assigned your request the reference number above.
As an initial matter, when we reviewed the list of requested items you had included
in your FOIA request, we determined that the numbering of the list included a discrepancy.
Because two of the listed items had the same item number (two item 3s), it appeared, at
first blush, that you had requested only nine items, when, in fact, you had requested ten
items. We have addressed this numbering discrepancy in the list included above so that it
reflects the fact that you have requested ten items and, the discussion below refers to those
item numbers.
The CIA Information Act, 50 U.S.C. ? 431, as amended, exempts CIA operational
files from the search, review, publication, and disclosure requirements of the Freedom of
Information Act. To the extent items 1, 3, 4, and 10 of your request seek information that
is subject to the FOIA, we will accept your request for these items and will process it in
accordance with the FOIA, 5 U.S.C. ? 552, as amended, and the CIA Information Act as
amended, and, unless you object, search only for CIA-originated records existing through
the date of this acceptance letter. As a matter of administrative discretion, we have waived
any fees associated with the processing of items 1, 3, 4, and 10 of your FOIA request.
To the extent items 2, 5, 6, 7, and 8 of your request seek information that is subject
to the FOIA, the Agency cannot accept these items of your request, in their current form,
because they would require the Agency to perform an unreasonably burdensome search.
The FOIA requires requesters to "reasonably describe" the information they seek so that
professional employees familiar with the subject matter can locate responsive information
with a reasonable amount of effort. Because of the breadth, vagueness, and lack of
specificity of your request, and the way in which the Agency configures its records
systems that are subject to the FOIA, the Agency cannot conduct a reasonable search for
information responsive to these items of your request.
In item 9 of your request, you have requested a Congressionally generated and
controlled document that is not subject to the FOIA's access provisions. Therefore, the
Agency cannot accept this item of your request.
