MEMORANDUM FOR THE PRESIDENT'S COUNCIL FOR MANAGEMENT IMPROVEMENT
AND ASSISTANT SECRETARIES/ADMINISTRATIVE DIRECTORS
,SUBJECT: GSA Regulatory Review - Progress Report
Since the last report of the General Services Administration (GSA), your
representatives to the Interagency Advisory Committee on Regulatory Review
(Enclosure 1) and its Transportation and Motor Vehicles Subcommittee
(Enclosure 2) have completed their review of draft revisions to the Federal
Property Management Regulations (FPMR) 101-38, 101-39, and 101-40.
The Interagency Motor Equipment Management Committee and the Interagency
Committee on Transportation and Traffic Management had reviewed initial
drafts of these regulations. All comments have been adopted or resolved,
and the final drafts represent fully reconciled proposed revisions.
I have approved the recommended revisions and authorized publication of a
60-day notice of proposed rulemaking in the FEDERAL REGISTER. I have
.enclosed for your information an advance. copy of the proposed-revised
FPMR 101-38, 101-39, and 101-40 (Enclosure 3) which will be announced in the
FEDERAL REGISTER.
The GSA's regulatory review project began 2 years ago with a discussion at
one of the meetings of the Assistant Secretaries for Management. The
product reflects what can be done through our collective efforts. The
transportation and motor vehicles regulations have been rewritten for
improved organization and clarity and the text has been streamlined.
Please convey to your representatives on the committee and subcommittee
my appreciation for their participation in this cooperative endeavor to
improve the FPMR. Their active support has contributed not only to
regulatory reform but also to.better communication between GSA and its
customer agencies.

SUBJECT: Change to Subchapter G--Transportation and Motor Vehicles
1? Purpose. This amendment transmits changed pages to Subchapter C--Transportation and Motor
Vehicles.
2. Effective date. The regulation transmitted by this amendment is effective upon publication in
the FEDERAL REGISTER.
3. Explanation of changes. A draft of the proposed changes was sent to the members of the
Interagency Motor Equipment Management Committee representing 19 major civilian
amendment is a culmination of the responses received and reconciled. agencies. This
a. Part 101-38 has been reformatted to provide for a more logical sequence of events on Federal
motor vehicle fleet policies and procedures, i.e., the regulatory material begins with the planning
for motor vehicle acquisitions and ends with motor vehicle disposal actions and the reports
necessary for the annual Federal Motor Vehicle Fleet Report.
(1) Subsection 101-38.301-1 is amended to prescribe the responsiblities of contractors that are
authorized to use Government motor vehicles.
(2) Subsection 101-38.401-2 is added to incorporate the provisions of FPMR Temporary
Rgulation E-78, Use of self-service pumps.
(3) Section 101-38.801 is added to provide agencies with the procedures to follow when
ordering Standard Form, 149, U.S. Government National Credit Cards from the embossing contractor.
(4) Section 101-38.802 is added to prescribe the requirement for controlled shipments of all
Standard Form, 149, U.S. Government National Credit Cards.
(5) Certain sections that are applicable to the entire Federal motor vehicle fleet are
incorporated into 101-38 from 101-25, 101-26, and 101-39. The left column below shows the sections
and subsections deleted or transferred into 101-38. The right column indicates their corresponding
locations in revised 101-38:

designated Interagency Fleet Management System (formerly the Interagency Motor Pools System). In
addition, 101-39 has been revised to reflect the transfer of 101-39.601(a), which covers Leasing
motor vehicles; 101-39.602-1, Government vehicles; and 101-39.603, Violations, to
Part 101-38 since these sections in 101-39 are applicable to the entire Federal motor vehicle fleet.
(1) Section 101-39.202 is added to indicate the Interagency Fleet Management System
services that are available to agencies and authorized contractors and subcontractors.
(2) Subsection 101-39.203-1 is added to advise Federal Government employees of the
availability of motor vehicles while on official temporary duty travel.
(3) Other minor changes were made for clarity with several subsections deleted and
