Of course, because these hearings constitute a congressional document, they are not subject to disclosure under the provi- sions of the Freedom of Information Act and FOIA requests for them have been rejected. Nevertheless, because of the ongoing interest of scholars and ~:he general public in intelligence activities, I believe that the extent that their release would not in any way imT~i e u 22n our national security in eres s, the hearings should be made available tote public. I have enclosed a copy of Representative Robert McClory's (R., IL) 17 March letter to Director Casey wherein the Congressman requests a declassification review of the 27 June 1947 transcript re House hearings before the Committee on Expenditures in the Executive Departments. CIA has completed its own internal review of the hearings and has concluded that there is no objection to its declassification from the CIA point of view. You will note that a number of military individuals testified during the hearings. Before we send the hearings back to Mr. McClory, we would appreciate OSD's review so that no military equities are compromised. If possible, I would appreciate completion of the review by 1 July.
