I have not coordinated the memorandum or the attachments. You may wish to coordinate these memoranda with various relevant components prior to sending them up to the DCI. This memorandum is to inform you of the status of Agency efforts to implement the FOIA relief legislation and to request that you sign the attached memoranda to the DDO, DDS&T and D/OS. 2. In anticipation of passage of our FOIA relief legislation, OIS has initiated the process of formulating Agency procedures on designating operational files as exempt from search review or disclosure under the FOIA. The establishment of such procedures is critical because under the terms of our bill there can be no relief from the FOIA until the DCI designates operational files located within the DO, DS&T and OS as exempt from the FOIA. Care must be taken to designate only those files which meet the designation criteria contained in the bill. This office, OGC and OLL have worked closely with the DO, DS&T and OS to formulate a process whereby only those files that can be considered operational are .recommended for designation. As a result of this preparation, we hopefully will be in a position to recommend designations of categories of operational files shortly after enactment of the bill. 3. In order to officially initiate the process of recommending designation of files, I would request that you sign the attached memoranda. I anticipate that in the very near future, Congress will enact our much needed FOIA relief legislation. The terms of this legislation specify that before we can obtain any relief, I must designate operational files as exempt from search, review and disclosure under the FOIA. It is therefore necessary for you to recommend those operational files within your office which can under the terms of the legislation be exempted from the FOIA. 2. While it is not necessary to compile a list of every operational file in the Office of Security which will be designated, I do expect to receive a list of categories of operational files that you believe should be recommended for designation. The function of files contained in these categories should be specific and well defined and must conform with the criteria stated in our legislation for designating operational files. In addition, appropriate steps should be taken to ensure that the categories of files to be recommended for designation do not contain any files which do not fit within the stated function of the category group. 3. I expect to receive your list of recommended file designations shortly after enactment of the FOIA relief legislation. Pursuant to a commitment the Agency made with the HPSCI and SSCI staff, these recommended designations will be provided to the oversight committees for their review prior to the actual designation.
