C. pprove or a ease 17-710. THE SECRETARY OF COMMERCE WASHINGTON 25 Under the Export Control Act of 1949 as extended, the Department of Commerce is responsible for the regulation of U. S. exports for reasons of short supply, foreign policy and national security. The Act requires the Department, in making essential policy determinations, to seek information and advice from other departments and agencies of the Government which have a primary concern in U. S. exports. The Department's Advisory Committee on Export Policy (ACEP) structure has provided an effective and satisfactory method of compliance with this legislative requirement. I am grateful to you and your official representatives for helping to make this possible. I am now approving a reorganization of the ACEP structure and a revision of its terms of reference in accordance with recent advice of ACEP members. As explained in the enclosed memorandum, the structure will continue substantially as heretofore, except for the elimination of the Joint Operating Committee. However, the responsibility of the ACEP structure will be related exclusively to U. S. export control policy problems, particularly in the two major areas of short supply and national security. It is expected that this action will reduce some of the administrative burdens on member agencies and the Department of Commerce, without impairing the effectiveness of the interdepartmental advisory system. The value of the reorganized ACEP structure will depend in large measure on maintaining representation at the highest practicable level so that the Department of Commerce will be provided with authoritative informa- tion and policy advice. Accordingly, it is my hope that, as a general rule, members of ACEP will be at the Assistant Secretary level, with their first alternates as members of the Operating Committee. I invite your Agency's participation on the reorganized ACEP structure as an observer for national security export control problems. For this purpose, I should appreciate your designating your representatives and alternates on the Advisory Committee on Export Policy and on the Operating Committee.
