u;.May 24, 1967, a Notice of Proposed Rule Making (NPRM) was
in the Federal Register (32 F.R. 7599) stating that the
e: rsl Aviation Administration was considering amendments to Parts 71
d 73 of the Federal Aviation Regulations that would designate a new
,oint use restricted area near Tonopah, Nevada, and include it in
the continental control area.
interested persons were afforded an opportunity to participate in
the proposed rule =king through the submission of comments. Due
consideration was given to all relevant matter presented.
The Air Transport Association objected to the establishment of
this new restricted area on the basis that (1) it overlies portions
of ? d::ra1 airway V-244 and jet route 3-80, (2) an effort should be
r de to relocate the restricted area to the southwest to reduce the
over - p of V-244 and J-tiO, and (3) a termination date should be
evtablished for the restricted area.

The Atomic Energy Commission is unable to predict a completion
date for the test program; therefore, it is not feasible to establish
a ter-:aination date for the restricted area. However, the FAA will
closely monitor the progress of the test program and upon its
completion, the restricted area will be revoked.
The possibility of relocating the impact area 30 miles southward
wws explored, however, extensive ground installations in R-4808 and
associated activity precluded this possibil4,.ty.

T-ie actual closure periods for this restricted area should
be brief and infrequent, an since the exact time of rocket firing
is not critical and can readily be adjusted, there should be no
significant interruption to air traffic on V-244 and Je-80.
in consideration of the foregoing, Parts 71 and 73 of the
Federal Aviation Regulations are amended, effective 0001 EST,
August 17, 1967, as hereinafter set forth.
1. In ?71.151 (32 F.R. 2061) "R-4814A Tonopah, Nev." and
"R-4814B Tonopah, Nev." are added.
2. In ?73.48 (32 F.R. 2317) Restricted Areas R-4814A and
R-4814B at Tonopah, Nevada, are added as follows:
