Mr. Pforzheimer and I discussed with Mr. Winslow
of the Civil Service Commission the application of the Performance
Rating Act of 1950 to this Agency. Mr. Winslow agreed that the Act
should not be applied in full to the Agency. He felt that, if neces-
sary, the Commission by regulation could meet the security requirements
of the Agency, but that such a regulation would not only lack clarity
but would not necessarily be binding on succeeding commissioners. Con-
sequently, if CIA requested the Congress for an exception to the Per-
formance Rating Act on the basis of its security requirements, he felt
the Commission would support the application.
