(a) None of the funds appropriated for fiscal 13 year 1983 or 1984 for the Central Intelligence Agency or 14 any other department, agency, or entity of the United States 15 involved in intelligence activities may be obligated or expend- 16 ed for the purpose or which would have the effect of support- 17 ing, directly or indirectly, military or paramilitary operations 18 in of against Nicaragua by any nation, group, organization, 19 movement, or individual. 20 ("(b)] This .ecitiof} shall take effect 46 ilay.R after the 21 date of eftaetfneftt of this cction HR 2760 RH Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 3 1 This section shall take effect upon the date prescribed in 2 the classified annex to the Committee report accompanying 3 this bill. 4 "(b) This section shall take effect upon the 5 date prescribed in the classified annex to the 6 report of the Permanent Select Committee on In- 7 telligence of the House of Representatives to ac- 8 company the bill H.R. 2760 (98th Congress).". 9 "AUTHORIZATION OF OVERT INTERDICTION ASSISTANCE 10 "SEC. 802. (a) The Congress finds that- 11 "(1) in the absence of a state of declared war, the 12 provision of military equipment to individuals, groups, 13 organizations, or movements seeking to overthrow gov- 14 ernments of countries in Central America violates in- 15 ternational treaty obligations, including the Charter of 16 the United Nations, the Charter of the Organization of 17 American States, and the Rio Treaty of 1949; and 18 "(2) such activities by the Governments of Cuba 19 and Nicaragua threaten the independence of El Salva- 20 dor and threaten to destabilize the entire Central 21 American region, and the Governments of Cuba and 22 Nicaragua refuse to cease those activities. 23 "(b) The President is authorized to furnish assistance, 24 on such terms and conditions as he may determine, to the 25 government of any friendly country in Central America in HR 2760 RH Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 4 1 order to provide such country with the ability to prevent use 2 of its territory, or to prevent to the extent permitted 3 by international law the use of international territory, for 4 the transfer of military equipment from or through Cuba or 5 Nicaragua or any other country or agents of that country or 6 any other country or agents of that country to any 7 individual, group, organization, or movement which the 8 President determines seeks to overthrow the government of 9 such friendly country or the government of any other country 10 in Central America. Assistance under this section shall be 11 provided openly, and shall not be provided in a manner which 12 attempts to conceal United States involvement in the provi- 13 sion of such assistance. 14 "(c) Assistance may be provided to a friendly friendly 15 foreign country under this section only if that country has 16 agreed that it will not use any assistance provided by the 17 United States under this section, the Foreign Assistance Act 18 of 1961, or the Arms Export Control Act to destabilize or 19 overthrow the government of any country in Central America 20 and will not make any such assistance available to any 21 nation, individual, group, organization, or movement which 22 seeks to destabilize or overthrow any such government. 23 "(d) At least 15 days before providing assistance to a 24 foreign country under this section, the President shall submit 25 an unclassified report which describes the proposed assist- HR 2760 RH Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 Approved For Release 2008/09/22 : CIA-RDP85B00457R000500020074-5 5 1 ance to the Speaker of the House of Representatives and to 2 the chairman of the appropriate committees of the Senate. 3 "(e) There is authorized to be appropriated to the Presi- 4 dent to carry out this section $30,000,000 for the fiscal year 5 1983 and $50,000,000 for the fiscal year 1984. U.] 6 "(f) Funds to carry out this section shall be 7 made available for any friendly country in Central 8 America only for the purpose of interdicting the 9 transfer of military equipment to any country in 10 Central America.".
