4. (Internal Use Only - LLM) Called Ted Kazy, House Post Office
and Civil Service Committee staff, to be sure that the Committee was aware
of the action by the Education and Labor Committee on H. R. 4757 which,
among other things, would place all Federal employees within the minimum
wage and maximum hour and other provisions of the Fair Labor Standards
Act of 1938 without regard to Title 5 of the U. S. Code which currently
covers these matters for most Federal employees.
Later John Martiny, Chief Counsel of the Committee, reviewed
with me the Committee's efforts on jurisdictional grounds to get Chairman
Perkins to back off in these areas, but he was not at all optimistic that the
Post Office and Civil Service Committee would prevail on jurisdictional
grounds. He said the Civil Service Commission is also opposing the bill
and that it is just possible that the problem will become moot if Represen-
tative John Erlenborn (R., Ill.) succeeds in substituting a narrower bill
on the House floor (see the file on S. 1861, 92nd Congress).
5. (Unclassified - RJK) Received a call from Chris Holmes,
on the staff of Representative William Mailliard (R., Calif.), who asked
for information about the Agency appropriations process to answer a
constituent request. The oral response I provided was sufficient and
I promised I would drop an Agency pamphlet by his office for his further
information.
6. (Unclassified - JMM) Made arrangements for Senator John
Stennis and Jim Woolsey, Senate Armed Services Committee staff, to visit
Headquarters tomorrow for lunch with the Director.
