I am writing in response to your request of June 12, 1974 in
which you request access to certain National Security Council
documents (TIR No. 6/12-4).
We have been. unable to identify or locate in our files the 1953
documents you described as the Reports of the Kelly, Bull and
Edwards Committees and so have been unable to review them
for release to General Research Corporation. With regard to
the other documents listed in your request, the NSC staff has
carefully reviewed them and has concluded that, without more

Access to NSC Material
General Research Corporation (GRC) has requested access to certain
historical NSC documents for use in their report on "strategic arms
competition between the U. S. and USSR" And you have asked the
staff for recommendations'', (See attached.)
Each staff member, except for Dick Smyser has responded and none
ha .0 any objections to granting GRC access to our documents, except
for Jan Lodal's office. Jan Lodal asked Roger Molander to comment
and he penciled his remark: "No -- they don't need this material for
their study -- can get info from DOD budget." Because it was not
clear whether Molander was referring to all requested documents or
only to the Killian Report, I asked him about his comment.
Molander feels'that we have not been given adequate information upon
which a decision may be based, and given the information supplied in
your memorandum he strongly recommends against allowing GRC
access to the referenced documents. Molander's reluctance stems
not from the sensitivity of the documents per se but from his concern
about the sort of product GRC is apt to turn out. Before he would be
willing to reconsider his decision he feels the NSC should have answers
to the following questions:
1. Who has commissioned the study and for what purpose?
What are the terms of reference in the contract regarding the
material to be reviewed and the information to be included in
the final report?
3. How will the NSC documents be used? Will they be cited and
quoted?

Based on the views thus far received we can go back to GRC (or Defense)
in one of two ways. Their request can be denied or we can ask them to

pursue the second course we should also ask for a more detailed reference
to the Reports of the Kelly, Bull and Edwards Committees which we have
been unable to identify and locate.

SUBJECT: Access to NSC Material by Defense Contractor
With reference to your memorandum of July 25 (#3518), I see no problem
with providing the Defense contractor with access to NSC-141, NS C-162,
NSC-5709 and NSC 1691-1696 provided that the material will be used only
in accordance with its Top Secret (XGDS) classification, that there will
be no downgrading of the classification and that DOD will ensure that
the contractor follows correct dissemination and control procedures
for material of such classification.

Access to Certain NSC Material by a Defense
Contractor
In reply to your memo of July 25, 1974, I concur with DOD's proposal
to make the "Killian Report, " NSC 5709 (blast shelter program), NSC
Action No. 1691, NSC 68, NSC 141 and NSC 162 available to the General
Research Corporation for the purpose of writing a "history of the stra-
tegic arms competition between the U.S. and USSR, " provided that the
history is either properly classified or submitted to the NSC Staff for
declassification approval. Further, in transmit ng our approval to
DOD, I firmly believe we should stress the necessity that they assure
tight control of the documents preferably by granting the contractor
access to the documents at DOD offices rather than loaning copies to
the contractor.

S OBJECT: Your Memo of July 25 -- Access to NSC
Material by Defense Contractor
From the point of view of Latin American affairs, we would have
no objection to release of the referenced material to the General
Research Corporation on the assumption that the security classi-
fication of this material would be maintained. The NSC Report
of January 1953 makes reference to military agreements which to
.my knowledge are still "secret". It also contains a reference.Vo
Brazil which would be embarrassing and detrimental to our national
interests.
The judgment then must be related on the reliability of the CRC.
I see no danger in leaks but only in publication of these references
in the report. If this is unlikely, then. I would have no objection
to turning over the material.
