This is in response to your memorandum of 19 August 1987
However, we are concerned that the proposed procedure for the
release of sensitive intelligence, as outlined in the final
paragraph of your memorandum, might be interpreted to permit a
decision on whether a release should be made without DCI
concurrence.
2. The DCI has explicit responsibility under the National
Security Act of 1947, 50 U.S.C. S 403(d)(3), to protect
intelligence sources and methods from unauthorized disclosure.
This provision of law, in conjunction with Executive Order 12356,
"National Security Information," makes the DCI the final
authority, short of the President, on declassification of
information relating to intelligence sources and methods.
Therefore, the DCI must approve any release of information
involving intelligence sources and methods.
