Attached for your review and comment is a copy of the above-captioned bill. By establishing the Federal Interagency Appraisal Council, it aims to reorganize and consolidate certain functions of the Federal Government relating to real estate appraisal in order to protect Federal financial and public policy interests. The Council will prescribe rules to determine which transactions are federally covered transactions within its jurisdiction, although certain transactions involving the appraisal of property worth $1 million or more are automatically considered to be federally covered transactions. See sections 103(g)(2) and (3). 2. Certain provisions of the bill seem to be of particular interest to the Agency. Section 106(h) authorizes agencies to detail personnel to the Council on a reimbursable basis. Section 107(d) states that the Council may secure from an agency any information necessary to carry out its functions. Section 107(1) provides that the Council may, with or without reimbursement, use agency research, equipment, services and facilities. Moreover, it may permit other entities, including private individuals or organizations, to use property under its custody and control. Although section 402(b) allows that the bill is not to be construed to relieve any agency of its authority to carry out its statutory responsibilities, it remains questionable whether this language is sufficient to protect sources and methods and guard against the unauthorized disclosure of classified information.
