That language follows: This section shall not apply to any contract when either the subject matter of the contract, or the fact of the contractual relationship between the Federal Executive Agency and the contractor itself, is classified pursuant to Executive Order 12356 and its successor orders or is otherwise protected by statute. We have presented this language to members of the Joint Committee on Taxation and the Senate Finance Committee. Their initial reaction was that there should be no problem with respect to exempting contracts when the contractual relationship is itself classified. We are in the process of arranging a briefing in a classified forum regarding the need to exempt contracts when the subject matter is classified, but the contractual relationship is not. I will inform you when this briefing will take place so that you may attend. As I indicated during our conversation, we hope to have this exemption presented as part of the technical amendments package which will be introduced in Congress within the next two weeks.
