SUBJECT: Public Building Amendments of 1987, H.R. 2790
1. We are concerned that wording in the proposed bill may erode the special
authorities contained in the CIA Act of 1949.
a. Specifically, it is not clear as to which part of the Public Building
Act the passage in Section 7 reading "(b) CERTAIN OTHER AUTHORITIES. -
sections 5, 6, and 8 of the CIA,Act of 1949" applies. That passage should be
clarified to reflect that nothing in the Public Building Act shall take
precedence over special CIA authorities.
b. There are several passages throughout the amendment that begin
"Notwithstanding any other provision of law., ...". These are broad statements,
and care should be taken to ensure that CIA's special authorities are not
impeded.
2. Section 3(b) LIMITATION ON LEASING CERTAIN SPACE. The limitations on
leasing secure or sensitive facilities may impinge on future Agency requirements,
and the requirement for the Administrator to report to the House Public Works
committee may bring undesired publicity to Agency activities. We would prefer an
exemption for CIA for this restriction, or provide that any exceptions on behalf of
CIA be reported only to appropriate oversight committees.
