MEMORANDUM FOR: Deputy Director for Intelligence

SUBJECT: Approval for Transfer of Funds to NOAA for Purchase
of LANDSAT Products
1. I request that you approve and sign both copies of the attached,
Memorandum or Agreement (MOA) between the National Oceanic and Atmospheric
Administration (NQAA) and the Central Intelligence Agency. The MOA provides
for the transfer of funds to NOAA for the purchase of LANDSAT photographic
products needed for agricultural and other intelligence assessments during the
current fiscal year.
2. Most of the LANDSAT products purchased fran NOAA are used in the
Agricultural Assessments Branch of OGI. They are essential to the branch's
Soviet, East European, and Third World crop assessments.
3. Because of the high cost involved, our analysts have made a concerted
effort to.minimize the amount of LANDSAT products required to ccmplete their
FY 1985 research program. Under the terms of the new Memorandum of Agreement,
CIA will transfer $2,000,000 to NOAA in FY 1985 for hard copy imagery and
computer compatible tapes. In the current FY 1985 budget, the projected cost
of these purchases is $3,590,000, the same as the funding level was for FY
1984. The amount to be transferred this fiscal year is $1,590,000 less than
projected because: (a) the number of LANDSAT scenes used in our sample to
estimate Soviet grain production has been reduced; (b) new exploitation
techniques, based on cheaper NO AA weather satellite imagery products, have
been developed; and (c) a digital analysis system, which OGI helped NPIC fund
in FY 84, will permit our analysts to use increasing numbers of LANDSAT
computer compatible tapes rather than the more expensive hard copy imagery.

MEMORANDUM OF AGREEMENT
BETWEEN THE
NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION
AND THE
CENTRAL INTELLIGENCE AGENCY
A. PURPOSE
The purpose of this Memorandum of Agreement is to establish the financial
mechanism for the transfer of funds for the purchase of Landsat data,
products and services from the Department of Commerce, National Oceanic
and Atmospheric Administration (NOAA), National Environmental Satellite,
Data, and Information Service (NESDIS) by the Central Intelligence Agency
(CIA).
B. AUTHORITY
1. The authority for NESDIS and the CIA to enter into this agreement is con-
tained in P.L. 97-324 and the National Space Policy Directive of July 4,
1982, regarding Civil Operational Remote Sensing.
2. It is the Administration's policy that the full cost for Landsat opera-
tions be recovered beginning FY 1983 through the collection of user
fees.
3. A portion of the annual operating cost is to be recovered by a transfer
of funds from designated Federal agencies to NOAA. The CIA is one of
these designated agencies. The transfer of funds from these agencies
will represent their share of the annual Landsat operating cost and will
provide for Landsat data, products and services not to exceed the amount
transferred.
C. RESPONSIBILITIES OF AGENCIES
1. NOAA/NESDIS agrees to:
o Provide and deliver Landsat data, products, and services as requested
under Article D of this agreement, provided such data, products, or
services can be produced or made available within the normal constraints
of the Landsat system. Costs for Landsat data, products and services
will be in accordance with. the attached NOAA Price List effective
June 25, 1984.
o Provide Landsat photographic imagery with radiometric and geometric
corrections applied. The products will include all related ephemeral
data pertaining to each individual scene. All processing will be
scene independent with no additional enhancements or data manipulations.
All scenes will be processed so that color relationships within scenes
are consistent. Color relationships will be extrapolated between
consecutive scenes in a single path (orbit). The only deviation from
the above is that the designated CIA point of contact may change, via
telecon, the color step wedge to which color balance is measured,
based on sun elevation angle.

o Deliver all scenes to the CIA within fourteen (14) days of receipt of
Landsat data at the NOAA ground processing facility at Goddard
Space Flight Center (GSFC). Requests for data already in the archive
will be fulfilled within twelve (12) days of notification to NOAA by
the CIA.
o Ensure that, until the tracking and data relay satellite system (TDRSS)
is available, no unnecessary delays will be incurred in the shipment
of Landsat raw data tapes from the foreign ground stations, which
will receive the data transmissions from the Landsat satellite, to
GSFC.
o Provide a monthly summary of those scenes collected and processed
for which acquisition costs are shared with other requestors.
2. The CIA agrees to:
o Transfer the sum of $2,000,000 to NOAA in FY 1985 for services in
accordance with paragraph C1. The CIA will transfer funds upon pre-
sentation of quarterly SF-1080 billing addressed to the CIA, Office
of Finance, Assistant Director for Liaison, Washington, D.C. 20505,
Attn: Norman Conde. The quarterly transfers are intended to cover
the cost of all Landsat data, products and services requested under
this agreement except as specified in paragraph 3.
o Provide the transfer of funds information which includes the agency's
name, billing address, code, treasury symbol, NOAA Landsat transfer
of funds identification task number, and the NOAA Landsat account
number.
3. In the event that the CIA requests Landsat data, products and services
with a total cost in excess of $2,000,000 NOAA shall charge for the
cost of such excess data, products and services on a per-request basis.
D. REQUESTS FOR DATA, PRODUCTS AND SERVICES
1. Effective October 1, 1984, requests for all Landsat data, products and
services shall be addressed to NOAA User Services, EROS Data Center,
Sioux Falls, South Dakota. 57198.
2. Requests shall be made in accordance with the Landsat Data Users
Handbook, as appropriate. In particular, each request shall include the
CIA's NOAA Landsat transfer of funds identification task number
(RN1B02) and the CIA's NOAA Landsat account number (0992453). The
identification should be combined to read RN1B02/0992453. If the
identifier is not cited in a request, such request shall be treated as
one outside the scope of this agreement and billed separately.

E. OTHER PROVISIONS
1. Nothing herein is intended to conflict with current Department of
Commerce and NOAA directives or CIA directives. If the terms of this
agreement are inconsistent with such directives, those inconsistent terms
shall be invalid but the remaining terms and conditions of this agreement
not affected by the inconsistency shall remain in full force and effect.
2. Should disagreement arise as to the interpretation of the provisions
of this agreement, or any amendment and/or revision thereto, that cannot
be resolved at the operating level, the area(s) of disagreement shall be
reduced to writing by each party and presented to the other party for
consideration at least sixty (60) days prior to forwarding to respective
higher quarters for appropriate resolution.
F. DURATION OF AGREEMENT
1. This agreement will be in effect from October 1, 1984, through September 30,
1985, or until terminated by mutual agreement or written notice by either
party thirty (30) days in advance of termination.
2. All direct and indirect phasing out costs shall be paid by the agency
requesting the'termination. Termination cost claimed shall not exceed
the actual costs incurred as a result of termination of this agreement.
3. This agreement may be renewed annually and amended by mutual consent.
