IN THE HOUSE OF REPRESENTATIVES MAY 22, 1985 Mr. WHITTEN, by direction of the Committee on Appropriations, reported the fol- lowing bill; which was committed to the Committee of the Whole House on the State of the Union and ordered to be printed A BILL Making supplemental appropriations for the fiscal year ending September 30, 1985, and for other purposes. 1 Be it enacted by the Senate and House of Representa- 2 tives of the United States of America in Congress assembled, 3 That the following sums are appropriated, out of any money 4 in the Treasury not otherwise appropriated, to provide sup- 5 plemental appropriations for the fiscal year ending September 6 30, 1985, and for other purposes, namely: Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 2 1 TITLE I 2 CHAPTER I 3 DEPARTMENT OF AGRICULTURE 4 COOPERATIVE STATE RESEARCH SERVICE 5 For an additional amount for necessary expenses of 6 "Cooperative State Research Service", $300,000. ,7 For an additional amount for a grant under the Act of 8 August 4, 1965, as amended (7 U.S.C. 450i) to the New 9 Mexico State University to help relocate the Fort Stanton 10 Experimental Station to another site, thereby making avail- 11 able land needed for a new Ruidoso airport; $1,200,000 to 12 remain available until expended, to be available only upon 13 the legislative transfer of the land from the Bureau of Land 14 Management to the Sierra Blanca Airport Commission or the 15 Village of Ruidoso and upon the enactment of an amendment 16 to the law establishing the airport improvement fund which 17 will permit Airport Trust Funds to help reimburse New 18 Mexico for its investment. 19 ANIMAL AND PLANT HEALTH INSPECTION SERVICE 20 For an additional amount for the Federal share of the 21 cooperative boll weevil eradication program, not to exceed 22 $650,000; and for an additional amount to restore funds bor- 23 rowed from other programs in order to conduct a grasshopper 24 control program, $10,000,000. HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 3 1 ECONOMIC RESEARCH SERVICE 2 For an additional amount for the Economic Research 3 Service to determine the losses suffered by United States 4 farm producers of agricultural products during the last decade 5 as a result of embargoes on the sale of United States agricul- 6 tural products and the failure to offer for sale in world mar- 7 kets commodities surplus to domestic needs at competitive 8 prices for use in determining what part of existing indebted- 9 ness of farmers should be suspended as a result of such for- 10 eign policy, $500,000. 11 STATISTICAL REPORTING SERVICE 12 For an additional amount for "Statistical Reporting 13 Service", $1,560,000, for the Quarterly Farm Labor Survey. 14 AGRICULTURAL STABILIZATION AND CONSERVATION 15 SERVICE 16 Effective May 1, 1985, none of the funds in this or any 17 other Act shall be available to close or relocate any State or 18 county office of the Agricultural Stabilization and Conserva- 19 tion Service. 20 FEDERAL CROP INSURANCE CORPORATION 21 SUBSCRIPTION TO CAPITAL STOCK 22 To enable the Secretary of the Treasury to subscribe 23 and pay for capital stock of the Federal Crop Insurance Cor- 24 poration, as provided in section 504(a) of the Federal Crop 25 Insurance Act of 1980 (7 U.S.C. 1504), $50,000,000. HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 4 1 FEDERAL CROP INSURANCE CORPORATION FUND 2 For emergency borrowing authority as authorized by 3 section 516(d) of the Federal Crop Insurance Act, as amend- 4 ed (Public Law 96-365), $113,000,000 shall be available to 5 the Federal Crop Insurance Corporation. 6 COMMODITY CREDIT CORPORATION 7 REIMBURSEMENT FOR NET REALIZED LOSSES 8 For an additional amount to reimburse the Commodity 9 Credit Corporation for net realized losses sustained, but not 10 previously reimbursed, pursuant to the Act of August 17, 11 1961 (15 U.S.C. 713a-11, 713a-12), $3,935,790,000. 12 OFFICE OF RURAL DEVELOPMENT POLICY 13 Of the funds made available by Public Law 98-473 for 14 the Office of Rural Development Policy, $209,000 shall 15 remain available until September 30, 1986. 16 FARMERS HOME ADMINISTRATION 17 SALARIES AND EXPENSES 18 For an additional amount for "Salaries and expenses", 19 $17,000,000, to provide for the review of farm loans held by 20 the Farmers Home Administration to determine, on a case- 21 by-case basis, which borrowers are unable to continue 22 making payments of principal and interest due to circum- 23 stances beyond their control and, thereby, qualify for tempo-. 24 rary deferral of principal and interest and the foregoing of 25 foreclosure as authorized by law. Other creditors shall be 5 requested to postpone payments due. 6 LOAN PROGRAMS 7 Effective November 12, 1983, and thereafter, the inter- 8 est rate charged by the Farmers Home Administration to 9 housing, farm, water and waste disposal, and community fa- 10 cility borrowers shall be the lower of the rates in effect at 11 either the time of loan approval or loan closing and any 12 Farmers Home Administration grant funds associated with 13 such loans shall be set in amount based on the interest rate in 14 effect at the time of loan approval. 15 FOOD AND NUTRITION SERVICE 16 FEEDING PROGRAM FOR WOMEN, INFANTS AND CHILDREN 17 (WIC) 18 The appropriation for the feeding program for women, 19 infants and children (WIC) contained in the conference 20 agreement on H.R. 5743 (House Report 98-1071), as en- 21 acted into law by reference in Public Law 98-473, is hereby 22 amended by striking out ", which shall be available only to 23 the extent an official budget request is transmitted to the 24 Congress". HR 2577 RB Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 9 1 NATIONAL TELECOMMUNICATIONS AND INFORMATION 2 ADMINISTRATION 3 SALARIES AND EXPENSES 4 (RESCISSION) 5 Of available funds under this head, $183,000 are re- 6 scinded pursuant to section 2901 of the Deficit Reduction 7 Act of 1984. 8 PUBLIC TELECOMMUNICATIONS FACILITIES, PLANNING, 9 AND CONSTRUCTION 10 (RESCISSION) 11 Of the funds made available under this head, $32,000 12 are rescinded pursuant to section 2901 of the Deficit Reduc- 13 tion Act of 1984. 14 RELATED AGENCIES 15 DEPARTMENT OF TRANSPORTATION 16 MARITIME ADMINISTRATION 17 OPERATIONS AND TRAINING 18 (DISAPPROVAL OF DEFERRAL) 19 The Congress disapproves the proposed deferral D85- 20 54 relating to the Department of Transportation, Maritime 21 Administration, "Operations and Training" as set forth in the 22 message of February 6, 1985, which was transmitted to the 23 Congress by the President. 24 GENERAL PROVISION 25 None of the funds provided in this or any other Act shall 26 be used for the enforcement of any rule with respect to the HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 10 1 repayment of construction differential subsidy for the perma- 2 nent release of vessels from the restrictions in section 506 of 3 the Merchant Marine Act, 1936, as amended: Provided, That 4 such funds may be used to the extent such expenditure re- 5 lates to a rule which conforms to statutory standards hereaf- 6 ter enacted by Congress. 7 FEDERAL COMMUNICATIONS COMMISSION 8 SALARIES AND EXPENSES 9 The Federal Communications Commission is authorized 10 to expend such funds as may be required in fiscal years 1986 11 and 1987 out of appropriations for fiscal years 1986 and 12 1987 for the Federal Communications Commission, not to 13 exceed $5,000,000, to relocate its Fort Lauderdale, Florida, 14 Monitoring Station within the State of Florida, to include all 15 necessary expenses such as options to purchase land, acquisi- 16 tion of land, lease-back of the present monitoring station 17 pending acquisition and construction of a new monitoring sta- 18 tion, architectural and engineering services, construction of a 19 new monitoring station and related facilities, moving ex- 20 penses, and all other costs associated with the relocation of 21 the monitoring station and personnel. 22 The Federal Communications Commission shall prompt- 23 ly declare the present monitoring station (including land and 24 structures which will not be relocated) excess to the General 25 Services Administration for disposition. The General Services HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 11 1 Administration shall sell such property and structures on an 2 expedited basis, including provisions for lease-back as re- 3 quired, and shall compensate the Commission from the pro- 4 ceeds of the sale all costs associated with the relocation of 5 the Fort Lauderdale Monitoring Station to another location, 6 not to exceed $5,000,000. 7 Any excess funds received by the General Services Ad- 8 ministration from the sale of the present property, less any 9 funds reimbursed to the Federal Communications Commis- 10 sion, and less normal and reasonable charges by the General 11 Services Administration for costs associated with the sale of 12 the present property, shall be deposited to the general fund of 13 the Treasury. 14 The authority under this Act with respect to the reloca- 15 tion of the Fort Lauderdale Monitoring Station shall (1) 16 extend through fiscal year 1987, and (2) be in addition to any 17 limits on expenditures for land and structures specified in the 18 Commission's appropriation for fiscal years 1986 and 1987. 19 FEDERAL TRADE COMMISSION 20 SALARIES AND EXPENSES 21 For an additional amount for "Salaries and Expenses", 22 $3,811,000, to remain available until September 30, 1986. Rept. 98-866) using funds hereto- 21 fore or hereafter provided. 22 Within available funds, the Secretary of the Army, 23 acting through the Chief of Engineers, is authorized and di- 24 rected to perform necessary channel and associated work in 25 connection with the Turtle Creek, Pennsylvania, local pro- 26 tection project; and shall take such action as may be neces- HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 31 1 sary to remove accumulated snags and other debris blocking 2 the channel of the Hatchie River and its tributaries in the 3 vicinity of Bridge Creek and the Little Hatchie River in Mis- 4 sissippi; and shall take such action as may be necessary to 5 perform necessary channel and associated work in connection 6 with the Glencoe, Alabama, flood control project. 7 Notwithstanding any existing agreement, within funds 8 otherwise available for the Yazoo Basin, the Corps of Engi- 9 neers is directed to operate and maintain the McKinney 10 Bayou Pumping Plant in accordance with the provisions of 11 Public Law 678 of the Seventy-fourth Congress, approved 12 June 15, 1936, as amended by Public Law 526 of the Seven- 13 ty-ninth Congress, approved July 24, 1946, effective after 14 the date of enactment of this Act. 15 Section 105 of Public Law 98-360 is amended by strik- 16 ing the words "at a cost not to exceed $450,000", and in- 17 serting in lieu thereof, the words "at an estimated cost of 18 $735,000". 19 The Secretary of the Army, acting through the Chief of 20 Engineers, is directed to construct the beach erosion control 21 project for Langdon Park, Wilmette, Illinois, under the au- 22 thority of Section 103 of the River and Harbor Act of 1962, 23 as amended, and in accordance with the cost-sharing provi- 24 sions in the Final Detailed Project Report, dated September 25 1983, at a total estimated cost of $270,000. HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 32 1 Section 14 of the Act of March 3, 1899 (30 Stat. 1152; 2 33 U.S.C. 408), is amended by inserting a colon in place of 3 the period at the end of the section and inserting thereafter: 4 "Provided further, That the Secretary may, on the recom- 5 mendation of the Chief of Engineers, grant permission for the 6 alteration or permanent occupation or use of any of the afore- 7 mentioned public works when in the judgment of the Secre- 8 tary such occupation or use will not be injurious to the public 9 interest and will not impair the usefulness of such work." 10 The Secretary of the Army is directed to initiate Con- 11 tinuation of Planning and Engineering studies for the 12 Maumee Bay State Park, Ohio, project at full Federal ex- 13 pense, using funds made available in Public Law 98-360. 14 The Secretary of the Army, acting through the Chief of 15 Engineers, shall grant, within ninety days of enactment of 16 this Act, to the University of Alabama. at Huntsville the 17 funds appropriated to the Secretary of the Army pursuant to 18 Title I of Public Law 98-50 for the design and construction 19 of a Corps of Engineers learning facility at Huntsville, Ala- 20 bama. This grant shall be made to the University of Alabama 21 at Huntsville subject to the conditions that the University 22 will convey the grant funds to the Chief of Engineers to 23 design and construct the learning facility on lands owned by 24 the University of Alabama and the completed facility is to be 25 owned and maintained by the University and be operated by HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 33 1 the University and the Corps as a joint use facility, all ac- 2 cording to such specifications, terms, and cost sharing ar- 3 rangements for operation and maintenance as the University 4 of Alabama at Huntsville and the Secretary of the Army, 5 acting through the Chief of Engineers, may agree. The Sec- 6 retary of the Army, acting through the Chief of Engineers, 7 shall report to the Committees on Appropriations of the 8 United States House of Representatives and the United 9 States Senate on a monthly basis on the status of the re- 10 quired agreements and the construction of the learning facili- 11 ty until such time as the facility is constructed and operation- 12 al at the University of Alabama at Huntsville. 13 The authorization for the Sardis Lake project, Oklaho- 14 ma, contained in Section 203 of the Flood Control Act of 15 1962, as amended by Section 108 of the Energy and Water 16 Development Appropriation Act of 1982 is hereby amended 17 to authorize and direct the Secretary of the Army, acting 18 through the Chief of Engineers, to plan, design, and con- 19 struct access road improvements to the existing road from the 20 west end of Sardis Lake to Daisy, Oklahoma, at an estimated 21 Federal cost of $10,000,000 and the State or political subdi- 22 vision shall agree to operate and maintain said facilities at 23 their own expense. 24 Notwithstanding any other provision of law, the Secre- 25 tary of the Army, acting through the Chief of Engineers, is HR 2577 RH--3 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 34 1 hereby authorized to enter into a purchase contract for the 2 acquisition of new buildings and appurtenant facilities for the 3 United States Army Engineer District, Walla Walla, Wash- 4 ington. Such buildings and facilities shall be constructed on a 5 suitable site in the Walla Walla, Washington area, which the 6 Chief of Engineers is authorized to acquire for that purpose. 7 The contract shall provide for the payment of the purchase 8 price, which shall not exceed $12,000,000, and reasonable 9 interest thereon, by lease or installment payments over a 10 period not to exceed 25 years. The contract shall further pro- 11 vide that the title to the building and facilities shall vest in 12 the United States at or before the expiration of the contract 13 term upon fulfillment of the terms and conditions of the 14 contract. 15 The Secretary of the Army, acting through the Chief of 16 Engineers, is authorized to design, construct, operate, and 17 maintain a Federal project for reduction of both flood damage 18 and navigation maintenance on the Toutle, Cowlitz and Co- 19 lumbia Rivers, Washington. Specifically, the Secretary of the 20 Army, acting through the Chief of Engineers is authorized to 21 construct a single stage retention structure near the conflu- 22 ence of the Toutle and Green Rivers with such design fea- 23 tures as the Chief of Engineers determines to be advisable, 24 including justified measures to mitigate for adverse environ- 25 mental impacts associated with the project; except that, HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 35 1 based on the results of Continuation of Planning and Engi- 2 neering studies, the Secretary of the Army may select, and 3 implement a staged sediment retention structure at the con- 4 fluence of the Toutle and Green Rivers or dredging alterna- 5 tive on the Toutle, Cowlitz and Columbia Rivers if he deter- 6 mines that continuing monitoring of sedimentation and fur- 7 ther analysis of benefits and costs provide compelling and 8 convincing new evidence to justify selection of a staged re- 9 tention structure or dredging alternative. 10 Prior to initiation of measures authorized by this sec- 11 tion, non-Federal interests shall agree to: 12 (1) convey or otherwise provide to the United 13 States, all lands, easements, and rights-of-way which 14 the Chief of Engineers determines to be necessary for 15 project construction and maintenance, including borrow 16 sites for the removal of material needed for retaining 17 works and disposal sites for the disposal of excavated 18 material; 19 (2) accomplish any alteration or relocation of 20 buildings, roads, bridges, or other structures or utilities 21 which the Chief of Engineers determines to be neces- 22 sary in connection with implementation of the project; 23 (3) in the event local interests are unable to 24 comply with requirements (1) or (2) above in a timely 25 manner, provide a cash contribution to the United HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 36 1 States, at such times and in such amounts as the Chief 2 of Engineers determines to be necessary to allow ac- 3 quisition of the property by the United States in ac- 4 cordance with project construction schudules; 5 (4) hold and save the United States free from 6 damage due to design, construction, operation, and 7 maintenance of the project except damages due to the 8 fault or negligence of the United States or its 9 contractors; 10 (5) operate and maintain any Federally undertak- 11 en mitigation project which the Chief of Engineers de- 12 termines to be justified; and, 13 (6) maintain all dredged material disposal sites. 14 All items of local cooperation shall be provided at the 15 time needed, as determined by the Chief of Engineers, and 16 without cost to the United States; except in the event the 17 Secretary of the Army selects a staged sediment retention 18 structure or dredging alternative rather than the single stage 19 sediment retention structure, any increase this selection 20 causes in the cost of local cooperation requirements, as deter- 21 mined by the Secretary of the Army, will be reimbursed by 22 the Federal Government. 23 Any goods and services purchased by the United States 24 in connection with the project authorized pursuant to this 25 section shall not be subject to the tax imposed by Chapters HR 2577 RH Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 Approved For Release 2010/09/27: CIA-RDP87M01007R000200590002-0 37 1 82.04, 82.08, and 82.14 of the Revised Code of Washington 2 and made applicable to contractors of the United States 3 pursuant to Section 82.04.190(6) of the Revised Code of 4 Washington. 5 The Corps of Engineers is authorized and directed to 6 initiate Continuation of Planning and Engineering for the 7 Virginia Beach, Virginia beach erosion and hurricane protec- 8 tion project, using available funds. 9 From funds available to the Corps of Engineers such 10 sums as may be required shall be made available to complete 11 the recreation facilities on the northern part of the Tennes- 12 see-Tombigbee navigation project as described in Volume 2, 13 Appendix D of the Final Supplement to the Environmental 14 Impact Statement provided to the Environmental Protection 15 Agency and the United States District Court but under the 16 same terms and conditions as those initiated prior to fiscal 17 year 1983. 18 From Construction, General funds heretofore or herein 19 appropriated, the Secretary of the Army, acting through the 20 Chief of Engineers, shall pay the judgment and any associat- 21 ed interest, resulting from the decision of the Engineer Board 22 of Contract Appeals in ENG BCA Docket Number 4815 23 (April 16, 1985), notwithstanding the limitation on allotment 24 of Section 107 of the River and Harbor Act of 1960 (Public 25 Law No. 86-645), as amended (33 U.S.C. 577).
