Section 2-208, E.O. 12036
1. Reference is made to your memorandum, subject as
above, dated 3 July 1978, wherein you requested to be
provided with our views, including supporting reasoning,
on whether our current collection techniques acquire
information "available publicly." You advised that
"available publicly" refers to information that an
member of the public could lawfully obtain by request,
by research of records or sources lawfully accessible
to the public, or by observation.
2. Our current collection techniques are as
follows:
a. National Agent Name Checks
These involve t fie review of other government
agency files which are not generally available
This involves the obtaining o in ormation
which generally could not be obtained by

b. Police and Credit Checks
These involve the collection of-information
which is not generally available to members
of the ppuu'b'Tic due to, among other things,
the laws of privacy.
c. Informants, Neighbors and References-
to the public.
