Webster Director Federal Bureau of Investigation Washington, D.C. 20535 Dear Judge Webster: 1 5 OCT 1984 Reference is made to your memorandum to the Director of Central Intelligence dated 4 September 1984, in which you request this Agency's "1-Anra in dcAiel oping information relative to the whereabouts of in connection with his international narcotics activities. YOU specifically request that we forward such information to the attention of the Fugitive/General Government Crimes Unit, FBI Headquarters. As you know, section 102(d) of the National Security Act of 1947, 50 U.S.C. 403(d), provides that "the Agency shall have no police, subpoena, law enforcement powers, or internal security functions." The Department of Justice has advised, in response to specific questions put to them 25X1 regarding our authority to collect information on , that : "...this law enforcement proviso would bar CIA... from pursuing fugitives abroad as a general matter, i.e., outside the course of lawful intelli- gence investigations." Therefore, please understand that this Agency will not engage in the collection or any other activities, the ur ose of 25X1 which would be to aid in the apprehension and prosecution of On the other hand, CIA will continue to collect and disseminate information concerning international narcotics activities. If, of course, in the nurcuit nf these activities, we incidently acquire 25X1 information on we would pass that information to the FBI to the extent permitted under Executive Order 12333. Webster Director, Federal Bureau of Investigation SUBJECT: REFERENCE: Assistance in Obtaining Foreign Intelligence Concerning Narcotics Activities in the Bahamas Memo to DCI (Attn: DDO) from Asst. Director, Criminal Investigative Division, FBI, Subj.: 8 July 83 1. In referenced memorandum, the FBI requested our assistance in the collection outside the United States of foreign intelligence concerning international narcotics matters. I was advised that, although you were not in Washington at the time, this request was approved by you. This memorandum confirms my previous approval of the requested assistance. 2. As I understand the underlying facts, the FBI is essentially concerned with activities that are presently takin7 25X1 place in 25X1 25X1 25X1 25X1 that is believed to be used as a focal point for narcotics trafficking to the United States. The FBI is aware of a number of persons believed to'be the k persons involved in the narcotics operations, including The FBI is interested in obtaining foreign inte lgence concerning the narcotics activities taking place on the island and with respect to movements to and from the island. 3. I am advised by my General Counsel that the requested assistance, involving as it does the acquisition -41.,f foreign intelligence particularly as it relates to narcotics activities is consistent with Section 2.6 of Executive Order 12333 and the National Security Act of 1947.
