Magee Director of Personnel SUBJECT: Draft Department of Justice Bill Prohibiting Payment of Annuities to Federal Employees Convicted of Certain Felonies REFERENCE: Multiple addressee memo f dtd 6 Jan 84, Same Subject 1. As requested in the reference, we have reviewed the draft Department of Justice (DOJ) bill prohibiting payment of annuities to Federal employees convicted of certain felonies. The language in the DOJ proposed bill seems to provide harsher treatment to Federal employees than those in the private sector. At a time when Federal employee benefits are being scrutinized and proposed for reductions, it does not seem proper to be issuing even further restrictions on U.S. Government employees. For these reasons, the Office of Personnel (OP) does not endorse the DOJ proposed bill. 2. If for some reason the DOJ bill is given favorable treatment and appears to be destined for passage, we should not endorse the proposal that anyone other than the Director of Central Intelligence (DCI) be involved in a notice and hearing process concerning Agency employees. We believe that any decision regarding the denial of a pension should rest with the DCI for all Agency employees, whether they are covered under the Civil Service Retirement System or the CIA Retirement Disability System (CIARDS).
