SUBJECT: OPM Draft Bill to Establish Special Rates of Pay
for Certain Federal Employees
1. We have reviewed the OPM draft bill concerning special pay rates
and your draft Agency response, and concur with your draft response. The
OPM draft bill represents a significant step forward in the Federal sector
in recognizing that there are unique circumstances other than direct pay
comparability which dictate that higher rates be paid to attract and
retain employees for an organization. This is the first acknowledgement
by OPM that additional flexibility is needed in the Federal pay system
and is a very hopeful note.
2. Your draft response is clearly correct in maintaining our
distance from OPM and Title 5, while at the same time supporting the
principles inherent in the proposal. It will help to set the stage for
later pay initiatives the Agency may wish to broach with OMB and the
Congress.
