Attached for your review and comment is a DCD legislative proposal to permit the dependents of United States Government personnel stationed overseas to attend the DOD Dependents Schools (DODDS) on a space-required basis. Office of Management and Budget (OMB) has requested the views of the Agency on this proposed legislation. 2. The DOD legislation would place all dependents of federal employees and military personnel stationed overseas on an equal footing when enrolling in DODDS. Currently, dependents of agencies other than the Armed Forces and DOD may attend DODDS on a space-available basis. The proposed DOD bill would change that to entitle all federally-connected children to enroll in DODDS on space-required basis. DOD has apparently adopted this change to prevent the attrition of non-military dependents and to ensure the continued vitality of DODDS. 3. This bill would entitle all federally-connected children whose sponsors are stationed overseas to enroll as space-required students in the Department of Defense Dependents Schools (DoDDS) in most instances. The Department of Defense offers the legislation in order to ensure equality of treatment for federally-connected students in the DoDDS system and to allay fears expressed by some other federal agencies, notably the Department of State, that their dependents are at a disadvantage in seeking a DoDDS education. That Department, for example, recently amended its Standardized Regulations to eliminate the requirement that non-Department of Defense civilian personnel enroll their children in DoDDS facilities when they are available. This amendment appears at paragraph 7 of the enclosed Department of State cable. The effect of this regulatory change will be to increase the amount of money the United States Government spends on private school tuition for its overseas dependents, with a corresponding diminution of the educational funds that are transferred to the Department of Defense from sister agencies (and thereby retained by the Government). In addition, the loss of students in DoDDS schools might reduce the quality of education offered to those who remain. This proposal is part of the Department of Defense legislative program for the 98th Congress. The Office of Management and Budget advises that, from the standpoint of the Administration's program, there is no objection to the presenta- tion of this proposal to the Congress. The Department of Defense recommends that the proposal be enacted by the Congress. Pur ose of the Legislation The purpose of the proposed bill is to place all dependents of federal employees and military personnel stationed overseas on essentially the same footing when enrolling in the Department of Defense Dependents Schools (DoDDS). Under the Defense Dependents' Education Act of 1978, as amended, 20 U.S.C. ?? 921-932 (1982), only the minor dependents of members of the Armed Forces and Department of Defense civilian personnel who are paid from appropriated funds are entitled to attend schools operated by DoDDS on a space-required basis when their sponsors are serving overseas. Other federally-connected children whose sponsors are assigned overseas must, under the statute, be treated as space-available students. Thus, DoDDS currently may serve such students only if it already has the necessary staff, materials, equipment, facilities, and other resources. The only exception to this legislative limitation is the Economy Act, 31 U.S.C.A. ? 1535 (West 1983), which permits the Secretary of Defense to create space on a reimbursable basis in DoDDS schools for other federal agency dependents if requested by the sponsoring agency head. Other agencies, however, appear to be reluctant to make Economy Act requests, with the result that _ their employees' dependents could be disadvantaged in obtaining an education from DoDDS. First, school buildings and other physical facilities, such as hospitals in the case of handicapped students, must be available to serve such children. Thus, for example, in areas where DoDDS schools do not exist the Department of Defense would not be obliged to establish them. Second, the bill would explicitly reaffirm the Secretary of Defense's authority to issue regulations prescribing the conditions and criteria under which students may enroll in DoDDS schools. The bill would also make a small technical change. As it currently reads, the Defense Dependents' Education Act, in dealing with military personnel, treats only members of the Armed Forces as sponsors whose dependents may be enrolled in DoDDS schools on a space-required basis. Under 5 U.S.C. ? 2101(2) (1982) and 10 U.S.C.. ? 101(4) (1982), the Army, Navy, Air Force, Marine Corps, and the Coast Guard comprise the Armed Forces. If the bill were enacted, all of the Uniformed Services (the Armed Forces plus the commissioned corps of the Public Health Service and~the commissioned corps of the National Oceanic and Atmospheric Administration, 5 U.S.C. ? 2101(3) (1982)) would be included. Enactment of this bill would not require other federal agencies to compel their personnel to send their children to DoDDS schools. It would, however, permit and direct DoDDS to educate federally-connected children whenever buildings are available. Moreover, since other federal agencies would be transferring their tuition dollars to the Department of Defense rather than spending them on private schools, the United States Government would realize a significant cost savings in educating its overseas dependents. Cost and Budget Data The enactment of this proposal would cause no increase in budgeting requirements of the Department of Defense and should yield a more effective and efficient utilization of Government resources.
