On 1 iiay 1957 I discussed with the DDCI and Genera Truscott the advisability of including in a revised NSCID 5 a speciAc pro- vision setting forth the Director's responsibility for the coordination of U.S. clandestine collection activities abroad. It was bur reneral feeling, as a result of this discussion that, while DCIL 5/1 set forth the procedures for accomplishing coordination of Agreed Activities, the Director's authority in this connection r4sted on only an implicit authority in the legislation setting up the organiza- tion and on the subsequent ESCIDs and that nowhere was such authority explicitly set forth. While it is true that such authority has not been directly challenged, it would be hazardous to assert that such a challenge will never be made. In any event, the discussfon with General Cabell and General Truscott restated in the decision, after we considered several alternatives, that the words 'which shall be coordinated by the Director of Central Intelligence" be exiii.ed to the last line of paragraph 1 of the current draft. 2. On reconsideration, such wording would cover para4:raph 1 but would leave paragraph 2 (dealing with counterintelligeLce) uncovered. The insertion of similar wording in paragraph would be desirable if it could be added in proper context. The organization of the paragraph is such that the same wordins,, would not _It smoothly into the paragraph. 3. It is suggested, therefore, that consideration be: given to adding to the draft a new paragraph (which would be paragrOph number 3, and would call for renumbering the current draft's )ara4reohs 3, etc.) which would read as follows: "The Director of Central Intelligence shall coordinate the Agreed Activities descrihed in the paragraphs 1 and 2 above".
