Dear Charles:
Last summer this Agency participated in discussions with 14 other
government' organizations and the Department of Energy (DOE) to ensure that
an adequate and uninterrupted supply of gasoline would be available to carry
out essential missions. Although most of the 14 organizations have responsi-
bilities in the areas of law enforcement or defense, this Agency is somewhat
unique in that it is a civilian intelligence organization responsive to the
President and the National Security Council. During this past summer, the
missions of each of the agencies which participated in the discussions were
being adversely affected because of the gasoline shortages.
As a result of the first meeting, DOE immediately revised title
10 CFR 211.103, which pertains to the allocation of gasoline. This change
assures base period usage to law enforcement and defense agencies during
periods of fuel shortages.
The Central Intelligence Agency's (CIA's) position at the outset of the
-discussions was that our mission and status are akin to that of the Department
of. Defense (DOD). Although the status of DOD and the law enforcement agencies
was clarified by the revision, the regulation did not specifically state that
the CIA mission is essential and, therefore, included in the change. Sub-
sequent coordination with DOE has established that there is some concern
within DOE on CIA's status as a civilian intelligence agency. The purpose
of this letter is to ensure that the Agency receives fuel at the 100 percent
base period usage level, similar to the allocation of other agencies per-
forming essential services.
Our facilities are widely disbursed throughout the Washington Metropolitan
area, as are those of our consumers. Traditionally, we have relied on the use
of private automobiles for official purposes, supplemented with a small pool
of official vehicles. As gasoline becomes more scarce and costly, our
employees have turned to the Agency to provide the transportation for official
needs. As a result, our requirement for official transportation is increasing,
and it is essential that the Agency continue to receive the gasoline it needs
to do its job. I would appreciate your certification relative to our allocation
level.
