This memorandum responds to your request in staff meeting on 8 October 1981 to give you our recommendations for acts that would be specifi- cally barred to former employees who desire an employment association with a foreign government. I wish to go on record that I am personally opposed to any attempt by the Agency to circumscribe the actions of former employees, either resigned or retired after they leave the Agency. I believe this is an overreaction to the case that is out of all proportion to the problem. If our laws nee strengthening then Congress should take appro- priate action rather than the Agency attempting to control employees in their future endeavors once they have left Agency employment. Such an attempt at administrative coercion by the Agency would mean nothing to those former employees such as who ow' gly break the law and who have complete disregard orethical stan ards. 2. If it is the desire of the EXCOM to develop a document which all employees would sign as a commitment of employment, I would recommend the following acts to be barred to former employees: a. You may not contract with a foreign government to advise or consult in matters of training for their personnel to handle special weapons, explosives, and demolitions or for the conduct of sabotage. b. You may not contract with a foreign government to advise or consult on building special devices to be used in paramilitary opera- tions. c. You may not contract with a foreign government to advise or consult with their intelligence service on the conduct of covert action in any form. d. You may not contract with a foreign government to advise or consult on the construction or operation of special intelligence collection equipment such as that used in collection operations for SIGINT, overhead imagery, or missile electronic emanations. You may not contract with a third party, either an individual or company, to perform any of the above acts. 3.
