1. The attached file indicates that there is a. rieo
understar din; of an individual's right to recover from the
Govern arct for Injuries and daz age, both among individuals
overseas and to ; o.ne extents, in the adrdiL.atrotive offices
in tashianaton. 3="or a lone period employees going overseas
have been intormod that they must get their belonginge over
the ws e l ve s s and take out insurance on them and that there
is tbere2'ore, no recourse a, ai.nst the 4ovornment. This is
a correct statement so ran as it goes. however, until
recently, some of the sz ployees have been told that their
belong-Sngs would be picked up,, packed and shipped by the
Government war*houae. They were also told that insurance
could not be obtained as the Goverrenent warehouse could
not be identified to the insurer. It appears that much
o. the belongings of these employees was damaged prior to
arrival overseasp and it is claimed that the 4amage was
due to negligence on the part of the warehouse. This
creates a oirciunstance outside of the general rule cited
above, since the Government has not permitted them to pro.
seed on their own, and has prevented insurance. Prior to
August 2, 1946, there was no general provision whiob peer-
witted the Government to accept and settle Tort claims, Lae*
elatma arising out of negligence or misconduct of Govern-
ment employees. The Tort Claims Act of that date, however,
provide for administrative settlement of such claims against
any a ;enc;r up to 1,000, and for judicial settlement of
claims over that amount, in situations `where the Oovernmant,,
were I t an individual, would be liable under local law.
Obviously p an individual, if he had been damaged by the act
of a CIG emplaoye*# could make c? airy against CIO under the Act.
In the specific oases herein involved, security would prevent
open consideration of' the claims and the facts should not go
