Referent memorandum requested the opinion of this Office on the proposed revision of Public Service Awards. One of the awards is the Federal Woman's. Awards, which "are granted to provide special recognition to women.... " 2. Section 703 of the Civil Rights Act of 1964 (42 U. S. C. A. 2000e-2) provides that: It shall be an unlawful employment practice for an employer... to discriminate against an individual with respect to his... privileges of employment, because of such individual's... sex.... Furthermore, Executive Order 11478 (8 Aug. 1969) entitled "Equal Employment Opportunity in Federal Government" states in Section 1 that: Approved For Release 2002/06/18 : CIA-RDP84-00313R000100260003-0 Approved For Release 200,W06/18 : CIA-RDP84-00313R00010026OQ 3-0 It is the policy of the Government of the United States to provide equal opportunity in Federal employment for all persons, to prohibit discrim- ination in employment because of... sex.... This policy of equal opportunity applies to and must be an integral part of every aspect of per- sonnel policy and practice in the employment, development, advancement, and treatment of civilian employees of the Federal Government (emphasis added). 3. As the first criteria for being considered as a candidate for the Federal Woman's Awards is being a female Government employee, the award is discriminatory because all Government employees cannot be treated equally in con- sideration for the award. Therefore, it is the opinion of this Office that because the award discriminates on the basis of sex, the Agency may not legally participate in the nomi- nation for or granting of this award.
