ITEMS OF MAJOR INTEREST - 6 - 12 November 1982
Foreign Intelligence Surveillance Act. In a recent
decision, U.S. v. Belfield, a panel of the United States
Court of Appeals for the District of Columbia upheld the
constitutionality of the provisions of the Foreign Intelli-
gence Surveillance Act (FISA) which allow a court to make
an ex parte, in camera determination of the legality of
electronic surveillance conducted pursuant to the Act.
The decision of the Court was reached after two defendants,
charged with murder and other related offenses in connection
with the assassination of Ali Tabatabai, raised the
constitutional question. Belfield is the second opinion
to conclude that FISA is constitutional. The first,
U.S. v. Falvey, was handed down in June of this year by
the United States District Court for the Eastern District
of New York
Wilson-Terpil Case. The trial of Edwin Wilson on
gunrunning charges will begin in the U.S. District Court
in Alexandria on Monday 15 November. The trial is
expected to end on Wednesday, barring any unforeseen
developments.)

Staffing the IG's Office:
Over the last two weeks I have met separately with Mr. Gates
and Mr. Stein to review IG staffing needs. Both profess enthu-
siastic support for our continuing effort to upgrade the quality
of the Inspection Staff. I will talk with Fitzwater and Hineman
in the near future.
