SUBJECT: Reply to Chairman Benjamin Rosenthal (D., NY) Re His
Memorandum to Subcommittee Members Regarding Agency
Documents on OPEC Investments
1. As you are aware, Chairman Rosenthal has sent the Agency, for your
comment, a memorandum he provided his Subcommittee Members proposing.a Subcom-
mittee vote on the question of taking the issue of declassification of Agency
documents to the House Floor. We informed his staff that certain portions of
the memo -(attached as Tab A) contained SECRET material. We advised the staff
that the material should not be distributed to Members' offices unless the
SECRET material is deleted. The staff indicated they would discuss this with
the Chairman.
2. The staff informed us that the Subcommittee will vote later this month.
The Chairman's draft resolution is at Tab B.
3. We'have discussed this matter with Mike O'Neil, Chief Counsel of
the House Permanent Select Committee on Intelligence (HPSCI.). While HPSCI
did not wish to intervene during our earlier exchanges with Chairman Rosenthal,
if the matter is referred to the Full House, they will then definitely take
a strong interest. O'Neil indicated they would seek and probably get juris-
diction on a resolution. O'-Neil's opinion at this point is that HPSCI would
assert its jurisdiction and sit on such a resolution.
4. Since Chairman Rosenthal asked for Agency comment on the memorandum
to his Subcommittee Members, I recommend you sign the proposed response which
is attached at left.

5. Of course, we will advise the White House, keep HPSCI advised, and
continue to monitor this situation very closely.
