This is in response to the request from your office of
Legislative Reference for the views of the Central Intelligence
Agency on Enrolled Bill H.R. 6955, the omnibus Reconciliation
Act of 1982.
The Central Intelligence Agency will be affected by the
provisions contained in Title III of the Act. That title makes
technical and cost-saving amendments to existing law regulating
government retirement systems and providing for certain travel
and transportation expenses. These changes will not directly
impair the Central Intelligence Agency's ability to meet
intelligence requirements. We do wish to note, however, that
one of these changes would have an unintended adverse impact on
Agency employees who participate in the Central Intelligence
Agency Retirement and Disability System (CIARDS). Unlike the
Civil Service Retirement and Disability System, CIARDS provides
for mandatory retirement at age 60. The changes made by
section 301 of the legislation are intended, we understand, to
create certain disincentives for persons who, before age 62,
retire voluntarily. This section will also have the effect of
penalizing CIARDS participants who retire before age 62, not
through their own volition, but rather through operation of
law. We believe this anomaly should be addressed by a technical
amendment at the earliest possible opportunity.
