(b) Special Categories:
(1) Classified information determined to fall within the
following categories may warrant some degree of classification for an
indefinite period and, therefore, is excluded from the provisions of
Section 4 (a), above.
a. Information originated by foreign governments or
international organizations and over which the United States Government
has no final classification jurisdiction.
b. Information specifically covered by statute, such as
the Atomic Energy Act.,and information or material requiring special
handling such as intelligence or cryptography.
L. Information which is identified in writing by the head
of a department or agency or his designee as extremely sensitive in
the sense that for a period of indefinite duration its unauthorized
disclosure
[1] Would place in immediate jeopardy a person,
system, plan, program, installation or method of operation
the continuing protection of which is required in the
interest of national defense, or

[2] Would seriously prejudice the effective
formulation or conduct of United States foreign policy.
(2) It is the intent of this Order that classified
information comprising the category described in subparagraph
4 (b) (1) L. shall be kept to the absolute minimum consistent with
operational requirements and the interests of national security;
that, in all cases possible, dates or events shall be determined at
the outset on or after which such information may be downgraded
even though not declassified; and that the authority to identify such
information as falling within the meaning of this subparagraph shall
be limited to tihose exercising Top Secret classification. authority
under Section 2 (d) (1) of this Order. Documents containing information
excluded from scheduled downgrading and declassification under the
provisions of this subparagraph shall be annotated in the body of the
text to indicate clearly to the recipient the information subject to the
exclusion.
