1. This memorandum contains a recommendation submitted for your
approval. The recommendation is contained in paragraph 4.
2. Over the past several years we have published quite a number of
regulatory issuances which were authenticated by you. A certain number of
these issuances required your authentication because of your special
authorities. It has also been the general practice to send to you for authentica-
tion any revisions or modifications of these issuances eve.. though they might
be of a minor procedural. nature. This practice was fol wed on the premise
that once you had authenticated an issuance, your signa re was required to
change it. The General Counsel has recently studied th s problem and is of
the opinion that any revisions or modifications of these issuances which do
not affect your special authorities need not be authenticated by you.
3. We therefore propose that in the future we submit to you only those
issuances or modifications: thereof which require your signature as a. matter
of law. Rescissions or revisions of those issuances which in the opinion of
the General Counsel do not require your signature would be authenticated by
the Deputy Director (Support) or Deputy Director (Plans) for headquarters
and field issuances, respectively.
4. I therefore recommend that you delegate to the Deputy Director
(Support) and Deputy Director (Plans) the authority to revise or rescind those
regulatory issuances presently authenticated by you which do not require
your signature as a matter of law.
