c. Michael A. Ledeen, executive editor of The
Washington Review of Strategic and InternationaItudies,
asked or copies oT estimates, Fe-search reports, assess-
ments, and biographic materials pertaining to
Communist Parties and Communist Front Organizations in
Italy, France, Spain, and Portugal, 1945 to the present.
The request, in its present form, is probably too vague
to qualify as a reasonable description of records.

2. Spotlighted Requests
a. Among the requests for personal files that
were logged this week was one submitted by Shirley
Chisholm, Member of Congress from the 12th Congression-
al District

d. John D. Marks expanded his ongoing request,
now in litigation, for records on CIA-sponsored or
conducted behavioral research to include any infor-
mation held by the Agency pertaining to "genetic
engineering." It will be handled as a separate re-
quest.
e. Our "college request of the week" came from
Murvin J. Glass, Jr., who requested all records the
Agency maintains on the University of California at
Santa Barbara. A new search should not be required
inasmuch as this institution was covered in a previous
request.
3. Spotlighted Responses
a. In partial fulfillment of John A. Kendrick's
request for information on the Serbian Orthodox Church
and its clergy, he was sent copies of 98 documents, 17
of which had been sanitized. Another 17 documents were
denied in their entirety. The request was submitted
by Mr. Kendrick, a Washington, D.C., attorney, on
behalf of a client, Bishop Sava, who is an official STATINTL
of the eastern diocese of the church.
c. Copies of the appointment affidavits signed by
Director of Central Intelligence Stansfield Turner and
by former DCIs William Colby and Richard Helms were
sent to Gene R. La Rocque, Rear Admiral (Ret.), Center
for Defense Information. He was also given a copy of
an employee bulletin, dated 1 July 1966, which contained
a transcript of the proceedings at the White House when
Mr. Helms was sworn in by then President Nixon, plus a
copy of the Agency's secrecy agreement.
d. Fifteen OSS documents, totaling 68 pages of
material, were forwarded to Joseph E. Persico, former
speechwriter for Nelson Rockefeller. Four documents
germane to his request had to be totally withheld.
This was the last of several partial responses prepared
in answer to a request submitted by Mr. Persico back in
late November 1976.

4. Analysis
The 2 May 1978 issue of AC?CE'SS Reports contains a
summary-of the contents of t Fe annua reedom of
Information Act reports to the Congress from the 12
departments. (The CIA was therefore not included.)
The experiences reported by them were similar to those
of the CIA--the number of requests received during 1977
showed an increase over the previous year and the cost
of administering the program also went up. The Department
of Defense logged 45,255 requests during 1977 and
reported expenditures of $5,523,610. The Department of
Health, Education and Welfare, which received 42,197
requests, expended $5,258,900.42 on the program. The
Department of Justice, with 18,996 requests, reported
the highest costs, $12,959,573.93, but this figure
included Privacy Act costs as well. The Treasury De-
partment received 15,662 requests and calculated its
costs at $5,272,658.
Agency-to-agency comparisons are difficult to make,
according to the article, because the reports vary in
format and different standards are used. For example,
not all agencies define an FOIA request in the same
manner. The Department of State lumps in E.O. 11652
mandatory classification review requests with its FOIA
request figures, and the Department of Justice apparently
combines Privacy Act requests with FOIA requests in
reporting its statistics. Congressional sources are
reported to have stated that the reports need to be
made more systematic; therefore, new guidelines may be
forthcoming from the Congress.

SUBJECT : Status of Request From Monica Andres, F78-0709
1. Attached is a copy of the request letter and a copy of
our letter of acknowledgment.
2. It has been our policy to defer the processing of
FOIA requests until such time as we have a firm commitment
from the requester that all reasonable search and duplication
fees will be paid. Exceptions are made only when we are certain
that the costs will be minimal or where, on the basis of previous
experience, we know that the requester is prepared to pay all
fees incurred in the processing of his request.
3. Ms. Andres' letter included a request that all fees
be waived in the public interest, but nowhere in the letter is
there any indication that, should the waiver request be denied,
fees would be paid. We are denying the request for a waiver,
and, in accordance with our standard policy, suspending the
processing of the request pending receipt of her written assurance
that any fees assessed will be paid. She also has the option
of refining her request in order to minimize search costs--e.g.,
if the request were to be limited to the two universities
singled out in the request letter as being of particular interest,
search costs would be reduced.

As you know, the amended Act provides that if some parts of a requested file are
exempt from release that "reasonably segregable" portions shall be provided. I
therefore request that, if you determine that some portions of the requested
material are exempt from release, you provide me with a copy of the remaining
material. I, of course, reserve my right to appeal any such deletions.
If you determine that any of the requested material is exempt from release, I
would appreciate your advising me as to which exemptions you believe cover the
material you are not releasing.
As you know, the amended Act permits you to reduce or waive the fees if that is
in the public interest because furnishing that information can be considered as
primarily benefitting the public." I believe this request plainly fits that
category and ask that you waive all fees.

This acknowledges receipt of your letter of 3 May 1978
requesting, under provisions of the Freedom of Information
Act, access to any CIA correspondence dealing with "guidelines"
governing university relations with the Agency.
Please be advised that before we continue the-pro-
cessing of your request we will have to receive your firm
commitment to pay the resultant processing fees. A copy of
our schedule of fees is enclosed. We have considered your
request for a waiver of fees, and have determined that the
amount of material that would be released to the public
would be insufficient to warrant such a waiver of fees.
Per paragraph (b) of the schedule of fees we are suspending
the running of the response time until we receive the above
commitment.
